Fabb Sofas In Administration

Around 2 weeks ago we purchased a sofa from FabbSofas , we put down a deposit of £250 on a VISA debit card and got 0% finance for the remainder of around £1800 .
The finance agreement was with Hitachi.
Am i right in understanding the finance company does not pay the money for the sofa to FabbSofas until the sofa has been deliverd ? So i should be able to ring Hitachi and get them to cancel the finance and then chase my debit card company for the return of the deposit ?

Yes contact your card company about a chargeback.
Worst case scenario, if your finance agreement was in place (not pending approval) then you should be able to do a section 75 claim with them for the return of the deposit.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

I notice in the hitachi credit agreement it states this
"Amount of Credit (the Amount of Credit will be paidby us to the supplier once the goods have beensupplied to you.) "
That is written next to the amount taken on finance , as we still had 4 weeks to deliver am i right in assuming this has not been paid to Fabb ?0 -
Ok rang them today
credit agreement has been canceled , as they had not paid FabbSofas yet which is good .
I was asked to forward on a bank statement to them showing the deposit had been paid to fabb , so have to wait and see what happens with that !0 -

If they're doing a section 75 claim, then the creditors are jointly & severally liable for performance of the contract. If you have a claim in law against the retailer then you have the exact same claim against the creditor and can choose to chase the only the retailer, only the creditor or both.

Also ordered sofa and paid £150 deposit with debit card and took the rest on Hitachi interest free for two years. (Had forgotten my credit card that day)
Called Hitachi today and credit agreement terminated.
Sent scan of receipt for the deposit to Hitachi this afternoon and got a reply saying either them or the administrator would be in touch in due course.
Does anyone know for sure if Hitachi Capital are liable to replay the deposit? Have had a wee look online but found nothing definitive.

Hi wondered if anyone could help me too..
I've bought a sofa with them. Paid in full. They have the sofa in the warehouse but have said they will not give it us. Surely as I've paid I own it and therefore have a right for what is legally mine.
Any light on this situation?

Your contract most likely states that you do not take ownership until delivery. How did you pay ? If by card then contact your card issuer to instigate a chargeback or s75 claim depending on type.0
