Evans Halshaw have sent us V5 for car we didn't buy

We’ve received the V5 log book for a car which we decided not to buy, and I’m not sure what to do next. The Timeline is:
19th May -Viewed car at Evans Halshaw Sunderland paid £100 to hold it, as it needed a good clean up.
26th May – Took the car for a test drive, but it still needed more cleaning and touch ups. We had a verbal agreement that we would buy the car and agreed go back to the showroom on 2nd June to check the condition of the car, and then complete the paperwork and make a debit card payment.
29th May – Phone call from Evans Halshaw could we pay for car on 31st May? Otherwise they wouldn’t guarantee the part exchange deal they’d offered, due to end of month valuations changing.
30th May – Email from Evans Halshaw with bank transfer forms for payment and saying they would deliver car on 2nd June.
31st May – I emailed Evans Halshaw to say we weren’t going to pay for the car without viewing it first and that we wouldn’t be going ahead with the purchase due to the pressure from them to change our original agreement. I asked for the £100 to be returned and had no reply to my email.
9th June – V5 log book arrives from DVLA stating that the sale took place on 31.5.18
I never signed any vehicle order forms or contracts, and I don’t want to be the registered keeper for a car I haven’t bought. Any ideas on what needs to happen next? Is it up to Evans Halshaw to sort out, or can I return the V5 to DVLA?

    Was your £100 deposit definitely returnable should you change your mind? Otherwise a contract was made-as later confirmed by your verbal confirmation (which has the same validity as written confirmation).
    The purpose of a deposit is normally to confirm a contract, not just to 'hold' the vehicle.
    No free lunch, and no free laptop ;)

    We were told on 19th May it was to hold the car, and stop it being sent to another dealer via the online move closer scheme, and the money would be returned if we decided not to buy.
    I never agreed to their telephone request to pay on 31st May, our agreement was for 2nd June. They were the ones that wanted to change the agreement. The telephone call was "pay on 31st or we change your part exchange valuation" Why should I give them my custom if that's what I was being threatened with? I don't understand why they went ahead and contacted the DVLA when I hadn't paid for the car, and I had put in writing why I would no longer be buying from them.

    Cannot see anything on their site that says the £99 deposit is refundable or not refundable.

    The £200 move it closer is refundable.

    I wouldn't have even bothered with the deposit, you never get a second chance to make a 1st impression.

    This one sounds quite odd. We wouldn't normally do the change of ownership paperwork until all funds for the sale have been transferred. It's not in either party's benefit to do so.

    Could you drop us an email on help@evanshalshaw.com or give our customer service team a buzz on 03333 239 178? Have the vehicle's registration number to hand and we'll get to the bottom of it for you. Be sure to let the team know if you're still waiting for that £100 back too.

    On the valuation bit:

    The value of a vehicle fluctuates daily based on local supply / demand which is why we can only keep a valuation valid for 7 days. Our team should inform you of this at the time the valuation is given - and offer to revalue your vehicle if the sales process takes longer than this. It shouldn't be used to pressure anybody, so I'll have a chat with our sales leaders about your case.

    The V5 isn't proof of ownership (it even says that on the front!). The V5 simply states the registered keeper which can be different to the owner.

    It does mean you'll get all the speeding and parking tickets when EH use this as a staff car to go to McDonalds at lunch time etc.

    Parking/Speeding fines, no insurance fines etc - best get it signed back over to the dealer, surprised you didnt do that straight away than coming on here asking for advice.
