Parking Awareness Services and Debtlogic

I have a LBC from Debtlogic for an alleged non payment of parking charge. I have followed as many threads as possible to this point and could do with some help with a couple of questions.
1. Should the LBC come from the "Debt Collector" or the Parking company? Mine is from Debtlogic. So is this correct? There is no evidence attached to the email and the email contains as PDF with a breakdown of the "fees" which is ridiculous:

Total Interest £0.00
Total Payments to Client
Total Payments to Debt Logic £0.00
Current Balance £185.00

Not sure how that adds up!

2. How does GDPR feature in these cases? Surely there is a breach if the Parking company "employ" a Debt Collector, as i have been informed, to seek payment? This is a third party surely and therefore breaches GDPR? I have repeatedly pointed this out but they have chosen to ignore my demand to remove my personal details from their records.

3. Should this go to Court, am I entitled to request that a Court near to me is selected rather than wherever the Parking Company are based?

In my case the alleged breach happened as the driver did not see any signs and we have taken video footage of the poor signage whilst turning into the car park from a busy road. There is a pay and display machine further down the car park, which the driver did not see as they did not drive that far down and therefore did not use. The "owner" of the business on one side of the car park is not interested in the slightest, I think he may be the owner of the land. And the manager of the business on the other side, when we approached them, just said there was nothing they could do.
We have written to DVLA, no joy!
We have asked about ANPR and when it is maintained etc. The response was that it uses GPS and therefore does not have to be. We have also asked for a copy of the lease agreement but had nothing.
The images of the vehicle allegedly driving in and then out of the car park are on the Parking Awareness website only, they have not supplied any copies. Are we entitled to copies as part of the LBC process?

    Post 2 of the NEWBIES tells you how to deal with court, including a response to a LBC. However, a debt collector cannot take you to court so I suspect this is a debt crawler begging letter, not a LBC.

    Parking Awareness Services do not employ anyone , debtlogic is owned by the same person that owns Parking Awareness Services , he simply changes letterheads and add extra moneys on

    well know on forums for his actions

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

  • Hi, I sent SARs to PAS and DL back in the summer. DL wanted a fee which I didn't pay as I thought they could not charge, but have never received a response. PAS eventually went round in clrcles to avoid replying to my SAR in the detail I requested. I eventually had a reply from Matthew Wild asking me to repeat my request all over again! I didn't bother!
    I have now had a letter from PAS dated 12/12/18 and one from BW Legal dated 12/12/18. I have had several "offers" to settle over this 18 month period. Currently the amount is £160 and I have now been asked to reply/pay in full within 16 days, which is around now, even though we have had 2 Bank Holidays!
    Just reading up on what to do next, it appears I wait for the LBC and then issue a SAR to BW Legal again?
    Or should I reply to BW Legal stating I will not pay and send the SAR now?

    grateful for advice.

    16 days is another debt letter , even though its now B W LEGAL (this is their initial foray into this "game")

    drop the SAR onto the PAS DPO yet again, as its a free service since last may, asking for all the data they have on you , using the GDPR weapon of law

    if they fail to do this , within 30 days , report them to the ICO

    I would do this now, dont wait for a 30 days notice LOC to arrive

    IGNORE b w legal for now, but get an LOC rebuttal ready, same as in the other B W LEGAL threads, ready for when the 30 days notice LOC arrives
