PCN @ High Point Village - Hayes & Harlington, London

Hello all,

I read trough the NEWBIES forum, but still hasn't found the answer I am looking for.

Long story short, I drove through the "High Point Village - Hayes & Harlington" and picked up my pregnant wife (who had been waiting there for me already), and so I never had to park there, just made a 180 degree turn (because the old roundabout was closed), and during the180 degree turn I stopped, my pregnant wife got into the car, and I drove away (I had stopped there for around 15-20 seconds).

- Next thing, I receive a PCN from PCM (Parking Control Management UK ltd, Company No: 4395994)
- I appealed and lost of-course.
- I have opened a Standard Appeal with IAS (BUT HAVE NOT SUBMITTED IT YET), however It says that "You have until 05/07/2018 23:59 to submit your appeal" which is end of today.

I did tick the following 2x boxes when opening the Standard Appeal:
1) You reported that you were the driver and the registered keeper at the time the parking charge was issued.
2) You reported that you are being held liable for the parking charge.

- After reading through all the posts at this forum, I am not sure if I have screwed up by opening the Standard Appeal with IAS and acknowledging the above two points...

Any advice before the end of today ? I did read in the NEWBIE forum that if this is PCM, I may try to submit a case to IAS... however I am not sure if I had done the correct thing to acknowledge the above two points.

    You have missed what it advises in the Newbies FAQ!


    (You are advised not to appeal to IAS)

    If you have inadvertently revealed your name in your post then edit it out as well as details of who was driving, unique ref no and anything else that identifies you!

    Today is 7th June. :D

    Not 5th July, nor 7th May.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    Hello all,


    thank you for your responces, I have now wrote an email to the local MP "mcdonnellj@parliament.uk", complaining about these horrific practices of PCM.


    As I mentioned above, I read in the NEWBIE forum regarding apealing at IAS and it says there that: "If it's PCM then give it a go as they seem to enter 'no contests' sometimes"


    I am putting my case together to IAS and I will use the same in front of the court later on...
    PCM portal contain about 8 pictures. 1st picture starts from when the car is about half way into the U-TURN and picking up my wife, remaining pictures show the car reversing "completing the u turn" and driving away. Each picture contains a timestamp. These timestamps accumulatively contain 21 seconds, including the pickup manouver. No evidence of driver getting out of the car and no evidence that the car was stationary for more than 1 minute, like PCM claim in their rejected apeal letter.


    I do have plenty more points that I will happily present to the jugde. I will try and find the company that owns the land, who recruited PCM, and complain to them as well. I do not see a point of dealing with PCM directly at this point.



    Any other advice ?

    Show us your draft IAS appeal before you submit it, and make sure you evidence everything you say as the Adjudicator won't be on your side.

    Note to newbies - IAS is NOT worth trying usually, but with PCM's flimsy predatory ticketing it can be worth a shot, bearing in mind as well that they are so litigious you may as well try to avoid a court claim. We do see PCM struggle to present a prima facie case to the IAS...

    my appeal to IAS is all in my PDF now, and it contains sensitive information, like picture, my wife's signature as the witness, etc... which is why I do not want to post it down here. I was going to perhaps send you a snippet in private message, but for obvious reasons you chose not to receive private messages. I did however receive a response from the "Portfolio Manager" at [FONT=&quot]Ballymore Group, [/FONT][FONT=&quot]this is the organization who should be owning the land, who was asking for mo details of the nature of my enquiry, so that he can direct me to the right people...     I am without a doubt a newbie and I do not know anything about the world of solicitors, and courts, and terminology and all the differet paragraphs etc... and so I drafted my appeal based on what I could think of in my mind.
