Hi,
So I had a "Parking Charge Notice" through from "Smartparking", for "unauthorised parking". The car park used to be a ticket machine but has switched to a 'smart' ANPR system, the old ticker machine was covered up so assumed to be out of order.
It was a ANPR system and it was 32 days from the alleged incident and receiving the Parking Charge Notice. Incident - 05/05/18. Letter sent (as dated) 04/06/18 and received 06/06/18.
£54 within 14 days or £90 + £10 admin fee after that.
They are unaware who the driver is. I am the owner of the vehicle. The letter says "if you were not the driver of the vehicle and you wish to provide the drivers details or lodge a dispute...."
I have read the Newbies thread but am still unclear as to course of action.
Any advice would be greatly appreciated.

Why unclear? Smart are beaten first go (usually no POPLA stage needed), just by using the NEWBIES thread template appeal, and there's only one. Nothing is unclear, submit the template online now.
Please don't copy it here and ask ''is it this one?'. Yes, it is.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

Okay great.
I was unclear over specifics of ANPR in relation to timing of notice, keeper etc.
I thought that I might be 100% in the clear if the letter had come late, meaning and NTK would be late also, etc.0 -
The letter I got was the same as the one linked here: https://forums.moneysavingexpert.com/discussion/5263486/pcn-for-fistral-beach-newquay-from-smart-parking
I was wondering, it's obviously a PCN, but is it an NTK?0 -
Yes, it's a Notice to Keeper.0

Great. Filling in an appeal and template now.
Sorry to keep pestering and thank you for your help - I've recently moved and haven't changed the VC5 to my new address yet, hence the letter went to my old address, does it matter which I put on the form?
p.s. you need to be nominated for an MBE for all you're doing on this forum!0 -
Use your current address and make a specific point of informing the PPC that your current address is the only address to be used from this point on..0

Submitted. I'll give an update when I hear back.
p.s. also going to write to MP and minister for transport. Specifically regarding forceful practice and ANPR flaws.0 -
Yep, a MBE (My Bloody Effort) is preferable to an OBE (Other Bug-ger's Effort)!p.s. you need to be nominated for an MBE for all you're doing on this forum!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
