How did you get deposit back
  • They refunded it
I emailed and then sent copies of 5 emails by recorded delivery and consumed large amounts of humble pie

Personally I think they know their T&C's are flawed so anyone prepared to fight will win, they will however still catch a few.

    Deposit returned less expenses
Sorry to have messed them about by cancelling and grateful to end the matter
Thanks to all on this forum and CAB also Rachel at Knights soliciters for invaluable advice

Good result, well done. IMHO humble pie works better than legal threats.

Out of interest can you tell us what the solicitors opinion was?
  • Solicitor gave lots of options including it could go on for 12 months and try direct approach
Gave lengthy replies costed at about £300 but waived charges

What a decent thing to do. So would it be fair to say the solicitor wasn't wholly confident you would win if it went to court rather it would be a bit of a gamble?

If so, given this wouldn't be a "small claim", that could be one heck of a gamble.
  • I decided that after reading solicitors options and possible charges that costs could be more than the deposit paid so took the personal approach which thankfully was well received by Crocodile
