Update***
Ive been to court today and the case was adjourned due to the claimant nor myself didn't receive any witness statements. what the judge did have to say though was, my defence wasn't binding it was persuasive, and if he had to make a judgement today it would be in favour of myself.
the claimant didn't have my address nor my name spelt right.
Still a bit P'd off that he would do this even though I did my part by serving all evidence and WS, but looking on the bright side I don't have to do much more than wait.
I was hoping people could clarify some things on here:
1. can I fine tune my witness statement as I didn't post it on here?
a.will the court accept it?
b.is it worth doing?
2. I didn't prepare a Skelton argument should I still do one?
3. can I contest the adjournment? as I feel I did my part and shouldn't suffer for the claimant's lack of care in filing the paperwork to me.

Did you forget to take to court, proof of emailing it to the Claimant? We would have told you to take proof in case they lied.

Which court was this at please?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

yes I did take all the evidence to court, yes I sent it to them via email I even took the proof that I send it via email the judge didn't look at it. The judge said these things happen and will give the benefit of doubt that the claimant didn't receive the documents. I was speechless.
it was failure on their part as I was transparent with everything and did my part by sending the WS and evidence to the claimant, they judge said because it was by email...and did a meh kind of look. he said I should have sent it recorded mail. I thought by email it would be more modern and wouldn't have any middle man plus its would be able to get "misplaced".
the judge knew the paralegal. (no disrespect intended) but I felt like he let it side cause they knew each other.0 -

I know I was away and had to ask my better half to send it in before the 14 days deadline.
I didn't bother posting it on here because I had already sent it in to the court and claimant.
If It was possible to amend before the next hearing I would post it up. I did ask the judge if I can amend and all he said was you can but you would have to serve it to the court swell. I don't know If I would incur any fees for that.0 -
