New build extras con!!

Hello

I am currently in the process of buying a wain homes new build property which isn’t built yet. The build was suppose to be completed in July and has now been moved to August (will probably end up September)

From the day we reserved and paid £500 they have pushed for us to exchanged in a tight timescale.

Sadly our buyers buyer pulled out just before we exchanged. Our buyer has a new buyer now who has nothing to sell so we wheels are rolling again.

I have informed wain homes that exchanged will now be delayed a little whilst the buyers buyer goes through the relevant legal checks. I am sad to receive an abrupt email that states if I haven’t exchanged by the end on June they will cancel my sale and put the property back on the market (fair enough but talk about cutting their nose to spite their face - mine if not already exchanged then would only take another week and would be quicker than them finding a new buyer anyway)

Anyway, in the email he mentioned that the extras I was pressured to pay for on Thursday will be cancelled this Monday and I will not be getting a refund - is this legal!!

I haven’t pulled out of the purchase and have spent money on extra things I want doing in my house before I move in.

Where do I stand?

    What did the paperwork you signed say in the terms and conditions?

    You are usually expected to exchange fairly early on when buying a new build. It's not like buying an older property where you wait for the chain to form. Has your solicitor not explained any of this to you?

    I don't think the OP has said that they don't want them - just that they were 'pressured to pay for them' upfront

    If is the case now. The next buyer may prefer totally different options. Resulting in the extras having no value.

    We are buying a new build and paid several thousand pounds for extras. It was a big risk because if the developer pulls the house from us (which they can as we are now past the 28 day exchange deadline) it was made very clear that we lose that money. I think this is standard when buying a new build? Extras are non refundable.

    Exchange is days away now and our buyer has already spent money ahead of buying our place so we!!!8217;re probably safe.... we hope

    Oh and we had to pay for them upfront, we thought we!!!8217;d be able to add them to the final bill but no.

    We bought a new build off plan 6 years ago from a smallish developer, not a 'one man band' but not into building large estates of hundreds.



    We paid nothing upfront apart from a £250 ( maybe £500) resevation fee. Exchange was when the rest of the chain was ready although I know the house was available to others to buy. £1000 deposit on exchange and then staged payments until the final payment when we moved in which included the extras. Between legal completion and our moving in they lent us a house rent free , we just paid for bills, they also paid for one lot of removals.



    If one developer can manage this the other larger ones should be able to.
