If a decision is made automatically then you have the right to ask for a human to look at it. It doesn't the answer will change
For example if you apply for a loan online & 10 seconds later computer says no, that is clearly an automated decision
You are also entitled to know the logic behind it, in the case of the PPC's
Car clocked going in at 12 clocked going out three. Time allowed for free parking 2 hours + 10 mins grace.
Therefore if you left at 14:11 you get invoice, that in the simplest form, is the logic.

in our case we bought a ticket and left well within the ticket period - the issue is we were 47 seconds outside the 'buy a ticket' grace period.
Are you saying we can request the details of the camera/P&D machine logic? in the automated decision process determining the infringement? They are saying the decision to 'prosecute' is done by a human and therefore exempt, only the referral to human is automated.0 -
Had a PCN from CPPlus there is no free way to pay their charges.
Ive written a letter but not sure who to send it to, or if its worth it.
Im interested in finding out if the admin fees charged by this company are legal.
As far as I can work out all fees have to be the same no matter which payment method is used.
Also am i not mistaken that all customer service numbers should be free from charges?
It is Now Illegal to Provide an 0845 Number for a Customer Service Line, found on googles web search.
Is a payment line not a customer service line?
This email is a slight rant but i wanted to check with you, i plan to pay the fine for £60 fine for 35 additional minutes.

What about on line banking?
This surely is a matter for your local Trading Standards Department.
But why on earth would anyone pay them without direction from a judge. Nine times out ot ten they are trying to scam you and It is the will of Parliament that these scammers, (often former clampers), be put out of business.
Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.

I've received a PCN to Keeper from NCP today for "parking without payment". They have photos of my car entering at 17:22 and leaving at 19:05.
Thing is... I did pay. I still have the ticket that says I paid £4.50 at 17:25 on that day and the ticket says it expires at 19:25. The reg on the ticket matches EXACTLY to the reg on the PCN that NCP have sent me now demanding £100 (£60 inside 14 days).
So, why have the DVLA given them my details as registered keeper? Do I have any comeback against the DVLA for them giving out my details without good reason?
The PCN notice even states that "If you consider that such information has been used or obtained inappropriately you may complain to the DVLA or the Information Commisioner."0 -
