I waded through it- here is the summary
Pushy yell salesman sold ad That's his job

Salesman's offer did not come true (not top of results list) OP appears to have Googled their business not searched on the YELL site, so wont be the top of Google.

    DD's set up on account
OP can't remember signing any paperwork You don't need to sign anything to agree a contract or setup a DD.

Call them and say that as you did not sign any paperwork they have no agreement with you. If you are sure you didnt sign any paperwork then cancel the DD's - without signed paperwork they cannot enforce it.

If you aren't sure, keep calling them to send you a copy of the signed agreement showing what you "agreed" to, so you know where you stand.

Where they stand they agreed to take an advert and got their advert. Someone running a business was shocked at a price excluding VAT? (surprises me).

You could not take 5 minutes to call them back? Really?

You do not need to sign anything to agree a contract as a verbal agreement is legally binding.

    https://www.bacs.co.uk/Services/bacsschemes/directdebit/services/Pages/Paperlessdirectdebit.aspx

Cancelling a direct debit does not cancel the contract associated with it and by following your advice, the OP could end up with a CCJ against them. (if they lost in court and did not pay what was owed).

Thats for a direct debit and nothing at all to do with any actual contract for services which in terms of a B2B transaction would 'almost' certainly of had either a paper or electronic contract signed.

I have had dealings with Yell and they are without doubt a bunch of lying vultures. Very high pressure sales (wanting to come to the house or meet you locally) and phoning almost daily until told very impolitely to 'just !!!! off'. I can see how more mild mannered people could end up suckered into some worthless crap advertising with them.
  • Hi - I might be able to help with this. Sales at Yell often take your bank card, they say to run a credit check on you to see if you can have the advert they are trying to sell. What they don't tell you is they are setting up the direct debit at the same time which makes an E-Contract (legal with business to business selling).

Now you are going to have a problem I'm afraid, If you cancel the DD and default they immediately refer you to Moorcroft who collect debts.

If you call you will not be able to contact the relevant cancellation team, there isn't one it's one designed to retain your business. That's if you get through, if they raise a ticket it will be weeks before it is looked at.

What I would do in addition to whatever you are doing now is email the Chief Executive of Yell. Email Richard.Hanscott@yell.com and copy in contactus@yell.com. On both quote you account number and details of the complaint as above saying how you were missold, pushed into it and it's effecting your health, Cancel the direct debit so they do not take any more money, it is a nightmare to get back. By emailing the boss of Yell it will mean the complaint is looked at quickly and dealt with correctly.

For the benefit of anyone reading this thread I have a lot of experience with Yell knowing a lot of staff who have recently left the business. They use E-Contracting and as soon as they get your card details they will sign you up. You will then be in contract and there is NO cooling off period as all contracts are business to business. Also what they are selling you won't be very good - they build websites / PPC campaigns etc. in India. They are one of the worst companies operating that I'm aware of.

    Hope this helps -

You seem to be offering contradictory advice here.....

  • True. I don't know a lot about the process once the debt goes to a third party, I believe you can have it paused while it is under investigation. Unfortunately I can't offer a guarantee - I would raise a chief executive complaint with Yell so it's dealt with quickly and by the best team to resolve it. I personally would advise Yell at the same time I was cancelling my DD until it is resolved.

Yes if you do that they might still refer it straight away to Moorcroft. If that is a concern *which it will be for most people". I would not cancel the DD immediately but give them time to respond to your complaint.

For your reference this is a very common issue with them. I would suggest reading through some of the 1 star reviews on trustpilot. Google "yell trustpilot". People seem to be either one or five star for their ratings. I'll leave it to others to decide which reviews are authentic and which look sometimes questionable. Not one of the 1 star reviews is verified - all the 5 star ones are. Does that mean all the 5 star ones are internally generated? I don't know but it looks very odd.
  • Thank you for everyone that had replied. When I was asked for my bank card I was told it was for a credit check. He got me to click links from my laptop as was supposed to be showing me facts and figures if I have signed a e signature it was done without my knowledge or consent. I have since found out this has happened to many other people. I still have the paperwork I haven't signed it and the accompanying letter says any problems call this number and it's blank. I have a letter from my bank stating two direct debits have been set up Yell are still denying this! I have been to citizen advice they spent nearly an hour on the phone Yell said they will pass it on to the complaints department I have heard nothing back. It was only then that I found out that I have signed a e signature. Is this just a box? Or do I sign sorry for such a stupid question but I am not technical at all. I have spoken to action fraud and my local police are coming out tomorrow to talk to me. I have since found so many people this has been done to its shocking. I was also told I could cancel as long as it was done within a month this I have since found out is not true. Yell must record conversation so you would be able to hear it's the salesman voice giving my bank details. He was here for nearly three hours.
  • The salesman was here for nearly three hours at that point I was not thinking straight at all I was worn out. I did ask him about the amount it wasn't until he was giving my bank card details over the phone to his colleague the salesman had my bank card in his hands trying to be '' helpful '' that I found out the amount he had told me wasn't true. trying to speak to Yell isn't a 5 min thing they pass you around to everyone you are told someone will get back to you but they don't. There was only one day that I couldn't speak to them.

See if you can get free legal advice locally there is a list here https://www.lawworks.org.uk/legal-advice-individuals/find-legal-advice-clinic-near-you

As a business the law is slightly different for you so a solicitor may be able to give your options as a business.

THREE HOURS! That is a ridiculous amount of time.

If I had allowed a salesperson in my house i would give them maybe 10 minutes to do their pitch, I can't see how they would need longer to give all the information. Then just tell them to give you key points in writing and you will contact them if your interested.

If they don't leave after 5 minutes of being asked tell them you will call the police if your not comfortable that you can get them to leave.

Did they set up a DD, or a CPA via your debit card?
No free lunch, and no free laptop ;)
