    So you and your brother are joint owners of the freehold title for the whole building (4 flats). As before you need to read the leases and insure the whole building accordingly. Individual insurance may not be valid and can invalidate each other in some circumstances.

    It's all guesswork at present.

    READ THE LEASES.

    Th leases specify

    * what each leaseholder can or can not do
    * what each leaseholder can or can not do
    * what the freeholder must do, or should force the leaseholders to do (or not do)
    * what the freeholder must pay for
    * what the freeholder can charge the leaseholders for

    Until you read the leases we are all just suggesting what they might say, or what such leases usually say.


    The other good suggestion made in this thread is for brother to transfer his share of the freehold to you. You will then have full control of the management of the building. Yes, that involves responsibility (but you already have that!), but it means you can be sure the building is maintained properly.

    You also then have a valuable asset.

    Just a quick update on this.

    I went to a solicitor the other week and what I have is a crossover lease.

    I am only responsible for the insurance on my flat. The chap who owns the flat beneath me is responsible for his own insurance, however, it is a requirement in the lease that the freeholder (me and my brother) are noted on his insurance policy. This type of arrangement isn't ideal in the case of a complete rebuild, however not uncommon.
