Shall I pay up?

I parked in a pay and display car park at a supermarket and the machines were "not in use". I assumed that as the machine didn't work that the other terms and conditions would be null and void, do you agree? Are there any regulations or cases I could rely on?
The car parking company have photographs of me entering and exiting the car park and exceeding the 2 hour limit. The two hour limit is on the signs in the car park but it also says pay and display too.
It's a bit confusing as the machines have been working on and off for months and it doesn't say on the machines that the other terms still apply.
Shall I just pay up?

What is the Newbie obsession with asking if you should pay? Have you read the thread that tells Newbies to read it first?
It's a whole thread dedicated to helping you not pay. In it are templates to use.
You should only pay after you hav stuck pins in your eyes.0 -
I f you read the newbies thread you will find all the advice you need.
When you put your aeal on their website don't name the driver and appeal using the blue, standard appeal that is on the thread.0 -

And this isn't even a newbie! You'd think a user with over 700 posts would know to look at sticky threads :eek:0 -

Hi
I have appealed using the template letter to euro car parks. They are saying their internal procedure is now complete and I can make an appeal to POPLA. I just don't know whether its worth the hassle and missing out on the reduced fine.
I expected people on the forum to be helpful, this is the first fine I have had in a very long time.
Ralph-y its Morrisons supermarket but it looks like the car park is managed by Euro car parks.
Thanks LPCompetition wins £14,136.30[\COLOR]0 -
Your post count doesn't mean you can get away with ignoring the polite request for everyone to read up on this in the Newbies FAQ thread before starting a new thread
All the help you need is there,
No-one here's going to advise you to pay.
Read up on popla appeals in #3 of the FAQ.
There is inevitable hassle in doing one
You are the only one who can decide whether to pay or fight!! (And it isn't a fine,!)
Complain to the retailer is the least hassle and gets good results from the retailer you are involved with0 -
There is no reduced "fine". You can guarantee that if you try and pay something will go wrong. They will find some reason to charge you the full £100.
We see it time and time again.0 -
as this is morrissons you should be emailing their donotreply mail address with a complaint as a customer and insisting this pcn is cancelled, same as hundreds of others have done before you

no idea why you havent complained to the retailer , they employed these par@sites so as a customer go direct to their head office, dont beat around the bush , email DAVID TOM POTTS (CEO) if you have to
Morrisons head office cancel these all the time
have you any idea why all these big companies are losing business , being sold off at a loss or going bust ? (like staples , homebase , new look , maplin , tesco direct , carphone warehouse etc) ???
yes , its because they have lost business due to parking companies infesting their car parks and driving away loyal customers, thats why , and Morrisons are no different , so tell them (M,s have just added ECP to my local store, against customer wishes)0 -
Definitely ^^+1^^. It will be cancelled. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
