HELP Please - APCOA PCN for not parking in proper space - Edinburgh Waverley

Hi All,
I hope you can help = the driver received a PCN from Apcoa in Waverley as they hadn't parked in a proper marked bay. There were no yellow lines or signs indicating they couldn't park - but it is (in very small print) on their signs. Do they appeal using the PCN template after 14 days, or do they need to pay this - technically they weren't in a parking space, but they had been very sore (had been treated at hospital the week prior) and there were no spaces on the top deck. They didn't want to park in a blue badge space, as they don't have one. Can you please advise what to do next - do they just pay it but it's £50 or £85 if it's left...and they had to pay for their parking ticket as usual to get out so it seems a double whammy!

You do realise this is a private parking invoice not a real ticket and is a rip off by unscrupulous greedy scammers don't you?
You have been looking in the wrong place, you need to read the newbies thread first with specific reference to Scotland, then come back if you still are unsure.

Hi both, thank you for your comments. I checked the newbie posts but there wasn't anything for this specific one. It is headed up "Parking Charge Notice". At the very top it states APCOA Parking (UK) Ltd which is who runs all the tickets / payments for the car park. You can't get out without paying for your parking which the driver did, so I'm not sure if we just ignore this, using the appeal template as mentioned on the newbie stream. It will be 14 days on Monday. They do say in the notice, which incidentally has no Parking Attendants details in - this is left blank, that they will contact DVLA for the details. It also mentions POPLA so I'm pretty sure we just ignore this until the so called letter comes via DVLA. Is that correct? Thanks again0

There are a number of reasons why you need not appeal including
1. It is on Rail property so they can't issue "charges"
2. The signs were not clear so no contract - which they can't offer anyway
3. You are in Scotland so unless you indicate who was driving they are pretty much stuffed.
4. They are not litigious

You might want to bring that to the attention of your local Trading Standards - Because POPLA has no remit to operate in Scotland.
Which means they are trying to mislead/misdirect you and that could be actionable.0 -

First, edit your posts to remove information about who parked or who was driving. Only ever refer to The Driver and The Keeper, who are two different people.
Once you have done this, you need to go back and read the NEWBIES again since you have missed the very specific information about Scotland, and also you have missed the bit telling you not to give away the driver's identity.
Please post a redacted copy of the PCN so we can see what CRAPCOA have said about PoPLA, as that will result in a complaint to the BPA and DVLA.
Wait until the keeper receives the NTK, before you complain as they may dig their hole deeper by mentioning PoPLA again.
The keeper should also complain to their MP and Sir Greg Knight MP about this unregulated scam.

Why don't people with a rubbish private PCN in Scotland, just search the forum for the word Scotland? No nee for any threads, this is already covered by the NEWBIES thread an any other one you care to read after a forum search for the single keyword:
