    I've already had a quick look at this and I believe they are in a contract with a third party management company called Jordan & Cook. They were not helpful at all, in fact the guy who spoke to me hung up the phone when he knew it was about a PCN. What interests me though is who would actually try and take this to court, it has to be the landowner right? So assuming a third party could not give permission, either way it seems fairly complicated.

    The idea is that J&C assigns their responsibility to manage parking to UKCPM via a contract.

    So you have to check

    a) do J&C have the responsibility manage that particular parking space (yes it does come down to that 24 sq ft). The driver may have pre-existing rights.

    b) If the did and it was correctly assigned was there a legitimate interest in charging £100.

    c) Was the driver aware of the signs pointing out (a) and b(b) above.

    I'm not sure how I go about getting this information, although I agree its important to find out. UK-CPM will definitely not tell me who employed them and neither will J&C, can I compel anyone to give me the info? Sorry but i'm still new to this 'game' and still trying to get to grips with these companies. Assume I need to find out through land registry documents who owns this land and go direct to them for as much info as they are prepared to give.

    What are the facts. Was this residential where you are a leaseholder, or an office where you work, or a retail site.

    Jordan and Cook appear to do residential work so are you a leaseholder, a visitor, and rental tenant or a service provider e.g plumber. What rights did you think you had to park there and what restrictions were shown on signs in the locale.

    It all turns on the facts. There are no 'magic words' though some make a living by getting people to pay for such.

    The facts are, this is a commercial car park in Cricketers parade, the car park has allocated parking for employees of local business around the edge and public spaces in the middle, The driver of the car apparently breached these regulations by parking with wheels over chevrons on the 15/04 because the registered keeper of the vehicle received a PCN / Invoice on the 30/04. Hope that makes it clearer?

    How far over. If it is limited, you can argue "de minimis". If there was a substantial part of the car on the chevrons, you'd have to look at the wording of the signs and did it make it clear that cars should be parked in specific places or was it "forbidding" such as parking on the chevrons is never offered.
    gather enough information to see any claim off at the first hurdle.

    You need a pic of the signs, their location relative to the car and the wording. If it goes to a claim you'd be surprised how often these companies put a pic of the wrong sign in their pack and the wrong site map too. So get your own.

    Just an update, registered keeper received a letter from UK-CPM about the invoice, stating it was now too late to pay £60 and the charge was £100 which was increasing to £149 in 28 days!!! Thought I would post that in light of this https://forums.moneysavingexpert.com/discussion/5868812/this-needs-greater-exposure .
  • Update - My SAR complaint to the ICO has been upheld on the basis that UK-CPM did not respond in the correct time frame. They now have 14 days to provide the information and the ICO do not rule out action against them if more upheld complaints arise. Keep it up everyone these SAR bombs may actually bear fruit.
