Lesiure Centre permit holders only PCN

After a visit to a leisure centre where the overflow car park was full, the car was parked in the smaller car park at the front side of the building. The keeper received a parking ticket for parking in what turned out to be a permit holders only car park. Whilst there was signage saying 'permit holders only,' the leisure centre is part of a sixth form as well, and it was mistakenly assumed that it must be a staff car park and since it was a Saturday it would be open to the public as many other similar centres do. I'm not sure if there is a defence and from what I've read from other forum posts can't really ignore it either, so any advice on if I should proceed with an appeal or am I going to have to pay up £100? The letter was handed to me at a later date as I wasn't staying at my home address at the time.

Have you read the NEWBIES FAQ sticky, post #1, which guides you through how to deal with this?

    Which parking company is involved?

    Date of parking event?

Windscreen ticket or letter through the post?

If letter through the post, date on letter and date of receipt?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Throughout here you are advised never to reveal who was driving

You need to edit your OP to remove details of who was driving

The ppcs monitor this forum and can use your posts against you
  • Apologies I didn't attach the image that had the additional details on it:
The parking company was Civil Enforcement Ltd. who sent a letter through the post. The incident took place on 28/04/18 and the PCN was issued on 04/05/2018. The date on the letter is 04/05/2018 also, however I'm not sure of the exact date of receipt as the letter was handed to me only recently, however I believe it arrived some time last week.

    Welcome to MSE.

    None of the detail matters.

Happily, CEL will fold when they see the template from the NEWBIES thread - it gives them a subliminal message that you are on MSE and will win, look:

Please don't copy the appeal template words here and ask 'is it this one?' Yes, it is, there is only one. Yes, it applies to your case, no, don't remove anything.

Come back and tell us when they cancel.

Why was the letter handed to you?

Do they have an old address?

If so you need to send them your correct address ,(they have 6 years to start legal action against you and you could end up with a default ccj registered against you that you know nothing about)

More editing of the OP required
  • Thought I'd just update that I used the template posted above and the ticket was cancelled!

    Thanks for the help.

Well done. CEL very often back off when faced with a forum template appeal.

Easy when you know how! Even with a 'hatchet job' appeal template. :D
