    [FONT=Verdana, sans-serif]There is also no coloured line round the entrance hallway. If this is shared then on the plan it might normlly be outlined in say brown and the lease wording granting access rights.[/FONT]

    If the deed itself (I'm not sure if that's what you mean by the "property details") says the garden is shared then that's all that anyone can "adhere" to legally.
  • If it does turn out that all the garden areas are "shared" - and you can't come to some agreement to informally decide "That bit is yours and that bit is mine and we'll keep off each others respective bits - even though we're allowed on them legally" = then I guess this would be where you buy a small attractive bistro set of garden table/chairs and put in the bit most obviously "yours" and a couple of nice plantpots with plants in in the bit that is most obviously "theirs" and play a share in removing weeds from both bits.

    This being to make it plain it is all shared and no specific bits attributable to any flat.

    But, obviously, it would be the best solution to agree informally "that's yours and that's mine" and you stick to a bit each and then neither of you has to consult with the other one if they want to plant a particular plant (ie in case the other party doesnt like the one that's in mind).

    The top wording sats garden to maisonette The middle one says ground floor flat garden and the bottom one says common garden The common garden is a small patch at the front with a few plants

    There are steps between the 2 gardens so the bottom one is about 9ft below which would mean we could use it but never would as its by their kitchen!
