    Hi Everyone ,
Our car ws parked in the car park next to the train station at Inverness - it requires a person the to insert their car registration number in before paying -

When the driver got back to the car they discovered they had put the incorrect number in - the driver didn't want to have to pay twice but kept the ticket in case they received a letter or a fine

The driver completely forgot about it until a letter arrived last friday telling the keeper they had been fined £60.It's a firm from Birmingham not the local Inverness Council

The driver is also disabled and lives on benefits and can hardly afford to pay £60 , this and the driver had already paid the parking fee !

There is an appeal form which the keeper will send off .
Any advice if the driver/keeper is turned down in the appeal ?
    .

post #1 still isnt correct, so I have amended the quote above for you, adjust post #1 to match it

YES , IGNORE this letter and any other letters unless the keeper receives a court claim in the post (I believe this may come from your local sheriff) - things are different in Scotland

keep the parking ticket that was paid for , for 5 years , and all paperwork too

Firstly, please refer to either the driver or keeper.
Obviously it was the driver who parked the vehicle and it was the keeper that received any letters.

By writing the way you have in your most recent post there is a risk that the driver's identity has been compromised.
Remember, it is very important that the driver's identity is not revealed when the parking event took place in Scotland.

Edit you post now to lessen that risk.

I would suggest the keeper ignores everything from now on.
In my opinion, you and the keeper run a great risk of revealing the driver's identity in any letter either of you may send.
    Ignore everything is my suggestion.

have since read that Smart Parking ignore all appeals
No they don't. You didn't read that here either.

Tell the keeper to stop engaging with them & come back only if Smart Parking later (within 5 years) try a small claim.

They have tried a few in Scotland but they need to know who was driving, so stop trying to help them by responding!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you both Redx and Keith - have amended the original post - have also learned a lot ! Unfortunately , as explained the keeper insisted on sending out the appeal as has been successful in the past but this Smart Parking company seem particularly keen on getting their monies it would seem . Have also informed our MP of our case -

if the keeper has appealed , as keeper, and without inferring who was driving , then no harm done

the issue here is when people blab about who was driving , because a driver has no protection in the UK and so may have to face a court case, which has happened in Scotland where people have blabbed about who was driving

so if you learn nothing else from this , learn to use the words THE KEEPER , THE DRIVER , and not the words "ME , MYSELF & I"

so what happened on the day happened to the DRIVER

and what happened since that day happened to the KEEPER

There was no inference as to who was the driver thanks to this site .

It is of course entirely up to you OP.

I won't be mentioning it again.
