Estate agents won't let us move out

    Don't send screen shots.

    Print your email off and go and see them. Tell Julie Kris messed up but that's not your fault if she didn't follow Julie's instructions ?or whichever way round it is).

    However as they have obviously misplaced their got of the communication you are just dropping it in your their convenience.

    Have a proper conversation with them

    Just received an email from EA:
    "Hi Evaldas

    Just to inform you that the move out date will be in September and there is no changing this I!!!8217;m afraid.

    Kind regards"

    My wife just went ballistic, found out solicitors called Anthony gold,I'll try giving them a phone call and see what they say.

    Don't waste money on solicitors.


    Simply move out by the end of the current fixed term: Take LOADS of photos (not that high quality.......) ideally with a witness & return keys before end fixed term.


    In the highly unlikely position that they sue you for unpaid rent you would very very likely win.


    As stated, many times before, they cannot prevent you leaving - any time you like. The only question is, do you owe rent (not if leaving by end fixed term..)

    Couldn't agree more with Artful. Do NOT waste money on solicitors unless and until you actually get sued. Just leave in June and cease paying rent, and it's up to the landlord whether they sue for the "unpaid rent". If they have their head screwed on right they won't even try, as the emails make it pretty clear there was an intention all round for the contract to end in June. If they do try, well, then you can pull in a solicitor if you feel you need to.

    I would reply with:

    Dear letting agent,

    On DATE you sent me an email with a copy of my rental contract with an expiry date of X June 2018. You asked us to come into the office to sign THIS contract.

    It turns out the contract you gave us was incorrect and had an expiry date of X September 2018. As this was incorrect and not what we had agreed on, we emailed you on DATE where Kris replied saying that it was indeed a mistake and the expory date is X June 18, as originally agreed.

    Therefore, as we have the above in writing and have taken legal advice on the matter, we will be moving out at the end of the contract date on X June 2018.

    We already have a new rental agreement which was bases on Kris agreeing that the end date was June 2018 as agreed initially.

    This gives you sufficient time to find new tenants for the property.

    Thanks! I think I'm going to copy this exact letter you wrote as it explains everything in one email. I will try to calm my wife and try to move out on agrees day of June. We're still on holidays,but estate agents made them really stressful in the other hand I didn't expect getting that much help here. This forum really works! Appreciate everyone's advice!

    Just received another email from Estate agents :
    "Hi Evaldas

    I have had a look at all the documents that you signed and can confirm that your tenancy end date is 16th September. As it stands at the moment, the landlord is not prepared to release you from the tenancy any earlier than that.

    I understand that Kris advised you otherwise, but I’m afraid this is not the case. The legal document that you signed was for the period up to the 16th September.


    You are welcome to vacate the property in June but you will still be liable for the rent until 16th September.

    I haven't send them that email yet as my wife really wants some professional advice on this case. I would like to move out and hope that it's the right thing. But all I see here is names of people trying to help us, but not their occupation if you know what I mean. This thing is scaring us a lot and I really need someone from that field to tell us the right thing and to have someone behind us.

    Well you have a choice.


    Stop posting here and ignore the advice given so far by people trying to help but whose occupations you don't know, and pay a solicitor or find a free professional.


    Or read bck through all the posts to see if there is any commonality in the advice, do some research yourself based on the information provided, and reach your own conclusion.


    But please - if you don't trust us amateurs, then don't waste our time. We give it freely, with the best of intentions (well, most of us!), but if you're going to ignore us, then just thank us and move on.
