Devere Parking Services Ltd Claim Form received

  • I've got a court date: 19 December 2018 at 10:00, and need to delivery all docs. to all parties by 21 November 2018 before 4pm.

    The claim is listed for a conciliation appointment on 6 November at 12:00 to explore with parties whether the case is capable of agreement or issues can be narrowed.

    Is this normal? Does anyone know what to expect?

    Nope, that is odd unless you agreed to Mediation, do you mean a phone appointment?

    if so, just decline and put the phone down; there is nothing to mediate.

  • Didn't ask for mediation, and it isn't a phone appointment.
    It is on my 'Notice of Allocation to the Small Claims Track (Hearing)'

    1) The claim is listed for a conciliation appointment at Bournemouth County Court on 6 November allowing 15 minutes when both parties must attend. At this appointment the District Judge will explore with the parties whether the case is capable of agreement or whether the issues between the parties can be narrowed.

    2) If either party fails to attend the conciliation appointment judgment may be given against that party or the claim may be struck out as appropriate.

    3) The claim will be heard at Bournemouth Combined Court on 19 December

    @OP - is the Bournemouth county court the one nearest to you? Devere are always keen to appear there, but far less excited about any other court venues!

    I'd suggest ducking/cancelling the mediation if you are convinced your lease gives you primacy of contract. You could even write to Devere to point this out and invite them to discontinue.

    IamEmanresu - I am going to go because I don't wan't not going to jeopardise the case. Also as I didn't ask for mediation so wan't to find out what exactly it is for.

    I nearly forgot, I sent an SAR to Devere and they sent me:

    "the full document and evidence that we shall be replying upon at the hearing" including;

    A copy of Devere's contract with Poole Quarter (Poole) Management Ltd dated 2nd August 2014. With a hand written note scrawled across it tell me to see part 14, which reads: No copy of this contract can be sent or transmitted to any third party without written consent of The Operator.

    A copy of pictures of the car (none through the side windows to show the permit on the centre console).

    Copies of pictures of random cars with permits.

    Copies of pictures of signage (small and illegible from distance and legible in the blown up A4 image). It is nice to note that at the bottom of the sign it says 'Parking permitted under the following conditions' then following, clearly visible in large letters 'Resident Permit Holders Only' - which I was.

    Finally a copy of landowners lease which states:
    Covenants Enforceable by the Landlord and the Manager
    To comply with and make all reasonable endeavours to ensure that all persons living in or visiting the Demised Premises or using the Parking Space or any part of the Maintained Property shall comply with any Managers Regulations which may be in force from time to time

    Does the sign not require the permit to be 'displayed'?
