    Europcar was contacted via the template taken from a similar case as to inform them that no payments shall be made or taken as it was close to the date said charges would be taken from the lessee

    “ParkingEye have placed this charge on hold for 28 days to enable you to provide the evidence requested. If this information is not provided within 28 days, the appeal may well be rejected and a POPLA code provided.
    DO NOT IMPLY WHO WAS DRIVING!!”

    Nothing will be said and no assumptions can be made! Would the recommendation be to reply to PE with a follow up letter? Thank you in advance

    This is the line from PE's reply that you wanted to see:
    If this information is not provided within 28 days, the appeal may well be rejected and a POPLA code provided.
    No need to respond to that.

    Wait patiently for your PoPLA code.

    You might want to prepare yourself by reading post #3 of the NEWBIES FAQ sticky thread.

    So they will reject an appeal even though they have been paid by Europcar? And in the meantime does the lessee of the vehicle keep bouncing any payments that try to be taken from their account by Europcar as it is effectively them chasing the money and not PE. Many thanks

    If they were to accept your appeal they would be tacitly agreeing that a refund needs to be made. Their reply indicates that they won't be doing that.

    Getting a PopLA code gives you the right to appeal to PoPLA where, with the right arguments, you should win.

    Ok, should the lessee contact Europcar to state an appeal has been lodged with PE (which is within their rights) incase any further charges or admin fees are falsely incurred?

    No, already told you what to do, put it in dispute with your card and Europcar. In post #4 I already said:
    Try searching BVRLA or europcar on this parking forum (not the whole of MSE!) and you should find several examples of robust fights and refusals to pay.

    Have you searched for those terms and changed the default search to SHOW POSTS and read them?
    Put the charge in dispute with your card provider and get it bounced because it's unauthorised and not a fine or penalty covered by the Europcar t&cs.
    In the same post I also told you PE would consider an appeal, and I was right, and their reply was nothing like you said it was! It was a normal holding response prior to rejecting an appeal and giving you a POPLA code. Which is what I told you PE will do...

    A little update Europcar has decided to help themselves to the £80 they!!!8217;re not entitled to! The lessee has paid their local bank a visit to have the unauthorised debit reversed and told them not to allow it again.

    I assumed this would happen whilst I wait for PE to reject my appeal send me a POPLA code.
