Hi,
I have recently received a ticket from a parking company called UKPS. I stopped in a pub car park
which is adjacent to a McDonald's in Leamington Spa for 5 minutes to eat a drive thru meal, which I have done many times before, I didn't even get out of the car! About 4 weeks ago I received my first parking notice demand for £60 from a company based in Leamington called UKPS.
I did some research on the internet and found the general consensus was to ignore completely but after the second letter arrived last week demanding £100 I researched it more thoroughly and found this website. I went back to the site and took photo's of the signage. The signs are present however They certainly don't stand out and as there are no payment machines I can honestly say I would never have see them in a million years. There were however two dodgy looking guy's sat smoking in old cars who wouldn't make eye contact with me who are obviously sat there all day to catch unsuspecting people like myself. The picture of my car shows an empty space next to where I was parked and I can honestly say there were no other cars parked nearby at the time of my offence. After reading through the newbie stickers and browsing the forum I decided it was best to reply with the standard letter supplied on the forum. When I logged onto their website with my claim number and number plate I was told I had missed the opportunity to appeal. I am now concerned how far this could go and don't know whether I should pay now of if I still have a chance to fight it.
Any advice would be much appreciated and I apologise if I have missed a similar case in the forum.

Thanks for your swift reply but I'm trying to ascertain if I am still too late to appeal? I read I can send them a letter with a proof of postage instead of appealing online but am I too late at this point? the date of the PCN was around the 30th March and I have received a second demand?0 -
yes you are too late to appeal, they told you this , 21 or 28 days is the limit for appealing
UKPS have 6 YEARS to try a court case using MCOL in the small claims court0 -

Thanks for your reply, I have read so much material on the matter recently that I couldn't see the wood for the trees! It's not that I can't afford to pay but I'm absolutely fuming with the way these sneaky thieving scumbags operate and are allowed to get away with it!!!!
They are registered with IAS and IPC accredited which means there was no point in appealing in the first place but after reading this account dealing with the same company I will send the standard appeal by email and post with proof of postage and hold tight!
Thanks again to everyone who gives there time for free and for the info and patience shown to law abiding citizens like myself who have never had any dealings with cowboy parking thieves and debt collecting firms and don't understand the jargon and bullying tactics used (although I'm learning fast):mad::mad::mad:!!!0 -

I've just received this reply to my appeal email, should I now just wait until I hear from the courts??
Thank you for your recent communication concerning the above Parking Charge. Please rest assured that our Appeals Manager has personally reviewed this case and carefully considered the various points raised. Their view, however, is that the Parking Charge is neither unreasonable nor unjust and so we will not be waiving this parking charge.
I understand when receiving a Parking Charge Notice its natural to look online for help, which by looking at your cut and paste letter that is what you have done. All these letters do is give the motorist false hope but escalates the charge from the reduced rate of £60 to £100 charge and then increasing when exported to Debt Recovery £160.
I note all your requests in your letter, however the author of the letters know we can not send sensitive information as they have requested as it is against data protection, we will only produce this information if and when it should go to court.
If you try to look at it unbiased and logically if an uninvited motorist came to your house and parked on your drive way or in your allocated parking bay you would not be happy? It is the landowner right to protect his property and if drivers park and do not comply with the terms and conditions they may be issued with a PCN. The operative witnessed that you parked you vehicle and Left and went towards McDonald's, the operative observed the vehicle for over 5 mins and issues the PCN.
I see that the charge has gone up to the £100 charge however, UKPS Ltd is still trying to resolve the situation and still will to accept the reduced rate fee of £60, this offer is available for the next 7 days after which it will revert to the balance without the price reduction.
All of your questions from the letter are either answered in this letter or you can view the photos taken of the incident online which the url address is further down.
The contract that UKPS Limited has with the owner or occupier of the land (which authorises UKPS Limited to enter into a contract with the driver requiring the payment of Parking Charges in respect of parking of the vehicle on the land) contains a confidentially clause and as such we are not in a position to provide the contract to you.
As a member of the Approved Operator Scheme, UKPS Limited are audited by the IPC to ensure that we have all relevant contracts in place. UKPS Limited will provide the court with a copy of this in full if they require it, or can provide a written statement to this effect from those party to the contract. We are also more than happy to provide confirmation to the independent assessors that we are authorised to manage parking at this site. We can confirm that parking management at this site has been contracted to UKPS Limited.
All of our signage is fully compliant with the guidelines set our within the IPC Code of Practice and we reject the notion that it is in any way unclear or ambiguous.
The highest court in the UK, the Supreme Court, has unambiguously confirmed that parking charges issued on private land are fully enforceable. In the case of ParkingEye v Beavis (2015) UKSC 67 their Lordships stated that private parking charges were enforceable because they served a legitimate interest and were in the interests of the public generally. The case confirmed that the amount of the charge does not have to reflect any loss that might have been caused by breach of the terms and conditions of parking.
The Supreme Court decision is binding law on all other courts throughout the UK.

We appreciate that this is not the outcome you will have hoped for. Unless you have any additional information that you have not already brought to our attention this decision is final.
In light of the contents of this letter you now have a number of options:
1. Payment offer of reduced rate for the charge above at the reduced rate of £60; to UKPS Limited. PLEASE REFER BELOW FOR PAYMENT OPTIONS AND ADDRESS DETAILS.
2. If you are not happy with our decision you can contact the IAS standard Appeals service within 21 days of this appeal being declined.
By law we are also required to inform you that the Ombudsman Services provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to IAS, as explained above.
3. If you choose to do nothing the parking charge will automatically increase after 7 days from the date of this letter to £100 and the matter will be passed to our debt recovery agent, at which point you will be liable to pay an additional charge of £60, in accordance with our terms and conditions of parking and further charges will be claimed if Court action is taken against you. Any unpaid Court Judgement may adversely affect your credit rating.
