I'd say it makes it invalid not "illegal". How did that happen? Has it actually been granted ?

Of course, if you and mum didn't notice, it may be the institutions you need it for don't notice either. If your mums second name is grisamellda but you've spelled it grisamelda maybe no one will notice.

OTOH if you've spelled Mary, Marie, they probably will.
  • her name is Philomena and has been spelt Philamena . She is in a care home and me and my sisters have poa, her house is up for sale and it is the solicitors for the estate agents who have informed me.

Was the LPA drafted by a solicitor or was this a DIY job?

Probably not an issue, but check with the Office of the Public Guardian, who are very helpful and respond promptly to general queries. Email them at customerservices@publicguardian.gsi.gov.uk

This is what is called a'slip of pen' error, and your solicitor should be able to make a statement of confirmation that the person is correctly identified.
It happens surprisingly frequently, and should be fairly straightforward to work round providing you solicitor is willing.
  • it was done by a solicitor. I am going to contact them tomorrow to sort this out. thank you.

For which you probably paid a grand more than you needed to as well. Get them to fix it at their cost.

Although mistakes made by a solicitor should be easier to get resolved than a DIY one. This should go down as a scribing error, and they should be able to resolve it directly with the convening solicitor, withou any cost to the OP.

We used solicitors do do ours and they made a mistake with mine, which meant they needed to do it twice, the second time at their expense. It was me however who got two lots of refunds after the price was retrospectively lowered.

It's still hard to see how this happened. OP would have had to sign the forms on which the name was already wrongly spelled. Those forms are then sent in and returned stamped. They are not transcribed or copied. So i wouldn't be at all surprised if solicitors claimed it was OPs mistake for not checking the names on the forms when they were signing.
