Hello all I am back with an update. I attended court and I am pleased to repoprt I won my case against VCS.
Arrived early and reported to the usher. Sat down and within 2 minutes the VCS representative came up to me and introduced himself and asked if he could give me a copy of the VCS witness statement!
The 50+ printed sheets of evidence that I received by post didnt include this apparently and he apologised. I politely refused and asked him to give it to me whilst in the company of the district judge. He tried to ask me other questions and tried small chat etc but I politely refrained from answering.
Called into the room at last and the judge went through the process and asked if both parties had received the correct bundles etc and of course I mentioned that I was offered the witness statement outside 5 minutes earlier! The look on the face of the judge was priceless!
However, this was not to matter as the judge had received all necessary documentation and this error would only cause an adjournment.
On to the matter in hand. There was no breach regarding POFA. Everything in order regarding this apparently.
There was no breach regarding the landowner and contract. I mentioned the contract was for 2015 and the following 12 months in which the judge then said ah yes and asked the VCS rep have you got an up to date contract in which after a few seconds rummaging around his files produced something the judge said was sufficient.
Then the judge went to town on the other evidence - mainly the photos of the signage.
The PCN was issued at night and from the photos the signs around the establishment were insufficient for a motorist to clearly see. The judge agreed 100% on this. The VCS rep said 5 signs were clearly sufficient for the area in which was small with only enough parking spaces for 15 vehicles.
The judge disagreed with VCS and said even she would struggle to clearly see the signs when driving into the establishment. She dismissed the case then asked me if I had incurred any costs.
I replied yes some minimal shift allowance wages but she said I had to prove it on the day so only awarded me token transport costs. To be fair I wasn't too fussed about the wages bit as I had booked a day holiday off work!

A pity you didn't apply for costs and inflict more pain on them. A days holiday is still a your time and you should have got some recompense.0
