Nevermind. I'm just going to delete this and call it a day as I seem to do everything wrong here. Sorry for the waste of time0

PBlinder, we often have a little spat at the start with a newbie. Because this is all for free, we do tend to get a bit irritated when people either don't do a bit of their own homework by reading the newbies thread, or when they respond to posts that can sometimes seem curt by being a bit ar*ey back.
The smart punctuation thing is a real pain, and where a post contains lots of those additional inserts a busy person who is best placed to help you will be less inclined to read it and therefore will not help you. So like someone else said, help us to help you. You wont get the help you need by alienating the very knowledgeable regulars. End of.
The reason for this post is this - the person who said they remembered you providing him/her with the VRN for the new whitelist. Get them to do a statement NOW. Draft it for them, take it down to them and ask them to sign it. It's really important.
Do it as a witness statement, with a court heading on it. I know there aren't proceedings yet, but just do it that way anyway.
At the top left, name of the court (this will be your local court) in capitals, bold and underline. Top right Case number: [then leave a blank space) - again, caps, bold, underline.
Then below that, on the left in caps and bold (not underlined) BETWEEN:-
Then centrally typed, the name of the parking co in bold, then to the right underneath that in bold "Claimant".
Then again centrally on the next line "and"
Then a couple of spaces and centrally in bold your name and underneath to the right of that in bold "Defendant".
Then centrally a line
Then under the line "WITNESS STATEMENT OF [NAME]
Then centrally another line.
Then this:
I, [name] of [address - can be the business address where he works], WILL SAY AS FOLLOWS:
1. I am employed as ....... [job title] at [address].
2. There is controlled parking at the building, run by the Claimant. Occupants and their regular visitors are entitled to place the registrations of their vehicles onto a "whitelist" of permitted vehicles. The purpose of the whitelist is so that the Claimant's operative know which vehicles are authorised to park and they will not then issue a Parking Charge Notice to those vehicles.
3. One of my roles is to keep the whitelist updated.
4. In about [month/year] I was instructed by my employer to delete the existing whitelist and to make a new one. I understood from what I was told by my employer that the reason for this was that the list had not been edited as people had moved out. I also understood from my employer that existing residents were told to see me to give me their vehicle registrations. Certainly, I was visited by a lot of the residents, who all gave me their car registrations and I entered these onto the whitelist.
5. I specifically remember [defendant's name] coming to me with his car registration for the whitelist. The reason I remember is [eg I recognise him as a regular visitor and he always says hello to me and we talk about Chelsea who we both support, - something like that that makes it believable that he remembers].
6. I make this statement knowing that it will be put before the court and believing its contents to be true.
then a statement of truth (wording in newbies thread)
Then signature and date
You need to get this now. Then bf sends it to the idiot PPC and tells them to stop harassing him and to stop processing his data because there is no claim.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I genuinely don't mean to seem touchy, maybe it's the stress from the situation. Sorry if I had come across like this though!
I honestly just want these invoices buried because the day they were issued was a very difficult day and I just want to forget about it.
Apparently my accommodation have had enough of dealing with smart parking because they one minute told me it was fine and then without a word prior they decided to tell me to just pay it and 'they'd fight it' which I don't believe.
So really I'm just upset and frustrated that I've been dragged into the whole thing again when I did everything asked of me previously to ensure I wouldn't receive anything from smart parking. I guess it's my luck ha.0 -
This whole situation has been going on since February so any time I relax and forget about it it seems to rear it's head!0

that's how they operate though, they scare you and harass you and most people end up paying the charges! So take a stand, learn on here how to defend it. Your bf has a good defence.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users.
