Smart Parking Ignoring Whitelist?!

Hi all,
Firstly sorry if this seems stupid I’ve read the newbies thread and need a little help currently arguing with smart parking and the stress is making me lose sleep!
My boyfriends car is registered on a whitelist in my student accommodation (I know it’s really funny that smart park own this, we’re students do they think we’ll pay?!) it’s got a small car park above and a small one on lower ground owned by smart park. Whitelist was cleared a month before we received the PCN so I went down and reregistered the car with my building manager who has evidence and recollection of me registering the car. Unfortunately when we submitted the first appeal we didn’t know about this forum and got a rejection letter. My boyfriends submitted an appeal to POPLA without using the newbie template mainly because we didn’t know about it ha. How do we fight the current PCN better on the basis that our car is whitelisted? We’ve received two other charges for the same day and will be using the template to appeal those but any help for the one my boyfriend messed up would be amazing. I’m kind of flabbergasted they’re even arguing the charge should be upheld considering as even the building manager remembers submitting it for whitelisting! :rotfl:thanks in advance.

For a start Smart Parking will not "own" the car park, you should be holding the building management accountable, it's their scamming contractor and scheme that is causing this they should be sorting it out for you.

I would tell the useless building manager that if this goes to court he will be called as your witness.

Please start by putting a few paragraphs in your block of text to make it easier to read.

As for appealing, just add a one liner to the NEWBIE template that the vehicle is on a whitelist and therefore the PCN should be cancelled.

Get something in writing to prove the car is whitelisted for future reference.

Firstly, I’m sleep deprived due to the stress so sorry about paragraphing but I’ve had enough of that after a million uni assignments.
We appealed with the basis that the car is on the whitelist and they couldnt care less.
Even though to further prove its on the list I havent reregistered it. We have received no more PCNs since but they are still adamantly insisting they are right.
The company I’m in accommodation with literally hand you a postit and say ‘here! Write your reg!’ And do it for you.
The manager is absolutely useless but the assistant manager is helpful and even she’s tried calling them.

Now you have done your popla appeal wait and see if you are successful.

If not #4 in the Newbies FAQ thread near the top of the forum covers the next stage and how to deal with debt collectors

Keep on at the accomodation manager to get this cancelled

just so you understand a little better re the murky world you have stumbled into ....

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.
