has his ex had any relationships since the split? If so, you could also do it on the grounds of her adultery, this would be harder for her to contest if there was reasonable evidence, e.g. if she was living with her partner, or regularly spent nights over.
When I divorced my violent, alcoholic now ex husband, about 9 months after I issued proceedings I started seeing someone (was a very long, bitter divorce on his part!) my ex said he was gonna do me for aldutery cos I was dating someone and I was "still his wife".
I advised my solicitor of this and he said not to worry, can only get done for adultery if still together, we were already well separated and on the way to being divorced.
Also, another point that has been raised re: serving of papers. My ex refused to send them back and was never at his accommodation to get a baliff to serve them; in the end I had to swear an affadavit that the papers were "deemed to have been served"
I guess what I am trying to say is no matter how awkward the other party is being there is always a counter move that can be done to negate their stupidity! lol

Hi Bottleredhead...im so happy for you that you got your divorce! Im really gratefull for all the advise has has been given. Its made me realise that it doesnt matter what a b$tch his ex is...theres always a way to legally deal with her. She wont win
P.S ive heard on the grapevine that she has just started seeing someone (poor fella lol) So i dont know if this will change her way of thinking about letting the divorce go through. xxx0 -
We had to get the baliff to serve them too because OH's ex did the same - refused to send them back - it took a bit of time, but they did it in the end and then things progressed, albiet with her delaying at every opportunity, but we've just been taking it slowly step by step. You just have to keep reminding yourself it will be over eventually (people on here have been very good at keeping me reassured over the last year!).Hi Bottleredhead...im so happy for you that you got your divorce! You are right, there is always something you can legally do. It can be a long process but you will get through it. I hope too that her new partner changes her perspective and makes it easier for you all. It is so unfair as she gets legal aid and my boyfriend earns just over the threshold to qualify for this and therefore has to pay for everything.
Similar to me years ago. Legal Aid people pursued me & I had to pay her costs too....albeit with 12 months of post dated cheques.....everything was supposed to be 50/50 & I suppose it was....she got the 'inside' of the house & I got the 'outside'!....it's a minefield, I wish you luck.0
