Paypal is refusing me my refund

    No, I think you need to prove he did as you are the one making the accusation.

    yea, when you make an accusation it is up to you to prove it, not the other party...

    Hello fellow MSE forum members,

    I decided not to reply to your posts since I was not getting anywhere and you all seem to mirror the fault at my actions.

    I just wanted to give you an update on how the claim went.

    I still did not receive my items nor a refund. PayPal did not even consider my section 75 claim.
    As a final solution, I contacted the financial ombudsman and received the claim was valid and that I am due a refund.
    To cut to the point, the financial ombudsman is in the same opinion as me, that being on my street or near my property and handing a parcel to someone, who stands in front of the property, is not enough to prove that the recipient has received their parcel.
    Also to the people claiming, that I said I waited all day. I never said I waited all day, I said I waited for the parcel to arrive. I received a time frame and I waited within the time frame. Please do not assume things only because they are comfortable for you.

    To everyone, who is in the same situation as me, please do not stop chasing after your goods or money, because some people think, they are clever. Do not get discouraged by setbacks and if you are in the right, take every option in consideration to get your goods or money back.

    Did the FOS agree that S75 applied, and that Paypal credit falls under their remit? (I wasn't aware that Paypal had signed up to the FOS scheme ... which specific entity of Paypal supplied the credit?)

    The refund was applied to my account.

    Paypal Credit falls under the S75, it is in their terms and condition. It is a credit option you can sign up to, through your Paypal account.
