ParkingEye Welcome Break overstay at night

Hi
Today I have received the PCN from ParkingEye for overstaying at night (from 2:34am to 06:59am total 4 h 24 m). 100 pounds to pay.
The driver was very tired and drove in to motorway service station to have a little sleep, The driver did not notice any signs as it was dark. The driver thought that there is no charge at night for tired drivers but now when the keeper received the PCN the keeper check street view and there are signs but there is nothing about night charges the only reference to 24/7 charging is in microscopic print in a different part of the car park.
I found the template on this forum to appeal, should I just blindly copy and paste?
Should I put my name? (I am the RK )
Any one knows how to find Welcome Break M3 contact numbers? I only found ones for customer feedback:) Should I contact them before I send appeal?
I apologise if you already covered similar cases on this forum,
my English is not very good and I want to make sure that I understand what to do.
Please help
Best regards
M

firstly, remove any hint of who was driving in your post
the DRIVER did whatever happened on that day
so the DRIVER was tired , the DRIVER overstayed, the DRIVER saw no signs etc
the KEEPER has since received the paperwork
use the template on their website choosing KEEPER
do NOT reveal who was driving , not to anyone at all0 -

Yes you put your name, the NEWBIES thread tells you that, under the template. DO NOT CHOOSE 'DRIVER' IN THE BOXES ONLINE.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD0 -
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0 -
Thank you very much for so quick reply!
I will do exactly what you advised and update with the result.
Will my credit score be affected? I have seen answer to this but just need to be sure because of re mortgage.0 -
Your credit score will be unaffected unless they take you to court, you lose, and do not pay within 28 days. You never know how far you can go until you go too far.0

You will lose the initial appeal, so don't be disheartened when you do. The initial appeal is to get a POPLA code.
You need to then come back here for a POPLA appeal. It will need to be based on signage so you will need photos to prove your point. Try Google Earth first. Other regulars may have other winning points as well.
I have to say that every Motorway service station I have been to has had reasonably clear signage offering parking over 2 hours or so for around £10.0 -
I have checked the google street view and there is big sign '2 hours free stay' but nothing about overnight charges, The driver thought that the fees are to keep the car park spaces for customers and it does not apply when all shops are closed and car park is empty.
The driver did not even see that big sign perhaps because the driver was tired but also it was dark (2 am) with no light on the sign.
Very similar to Nicholas Bowen case.0 -
Lettki - you were told, immediatly, to stop referring to the driver on the day in a way that identifies them
Edit your latest post, and stop telling the entire world who drove.0 -
Thank you again.
All edited now.
I have sent the appeals and I put the reason 'I was not the driver'.
Also sent them letter found on this forum.0 -
I did call to welcome break but they gave me an email address and asked to contact them by email.
Should I write exactly the same as to ParkinEye?0
