    I'm wondering if I can apply for it to be set aside. Because I wasn't informed and there's a wrong address on it. Do you think its worth spending the money?


    If you manage to get a set aside you still have the problem with the original debt. Based on the information in your original post you are still liable for it. If you are not currently being chased it might be worth keeping your head down but start working on a plan to address the debt if you are contacted. (ie Start putting some money aside)

    Yes, of course you can make such an application.
    Fill in the application notice (N244), and send it to the court along with the court fee of £255.

    Only you can decide if you think it is worth spending the money - perhaps it would be better off being put towards paying off your debt? :cool:

    Spoke to the estate agent the debt was being paid but the ex business partner had change the address and also paid it down to £50 left on it. What I was saying is that I knew nothing about this debt I can afford to have paid it all off, that isn't the problem. What I'm saying is that its on my record the address to the ccj isn't mine. I wasn't consulted about it from both parties. That's why I didn't go to court only found out about it because a credit check was run on me.

    Also just got my statutory credit report from experian and that, clear score, noodle etc doesn't have any thing with ccj recorded to my name. How is this do I have to do a different search?

    Do those agencies have the address used by the court to issue the ccj down as one of previous addresses?

    If I were in your position, I'd certainly get some legal advice.

    BUT, based on my experience I think you may have a chance of a set aside with a reasonable judge. But, only if you were able to pay off the debt right away and if you had consent from the claimant.

    It certainly would appear unjust that someone else supplied an address for you which has never been a correspondence address for you. But, you'd have to demonstrate responsibility for the debt and clear it right away. It may be feasible without consent, but would be far more likely with it, with a sensible judge.

    No I've never lived there and its somewhere in london
