Has anyone else had a giffgaff phone. My samsung s4 mini is under 2 years old and is under warranty. I returned it to giffgaff and i get an email saying there is a fault but not covered by warranty. No further details.
I have asked for more information. Has anyone else had a similar experience. I am not aware of anything wrong with my phone. It was working fine on friday night and one saturday morning it wouldnt switch on just the logo came up.

Thanks

Screen damage is the usual from any repair to be rejected under warranty/ CR .

Your warranty is a limited warranty from Samsung .
Your Consumer rights are against the vendor .

  • Hi, paid £450. For refurbished iphone from Giffgaff three months ago. Its still under warranty so returned it when it wouldn't turn on the other morning. They say its not covered under the warranty but neglect to say what the problem is.
Just a bill of £110.! I feel like the phone is being held to ransom.
Think so many others are experiencing the same inept "customer serviice" and four a phone company NOT to have a help line says it all really. Perhaps we should all bands together.and complain? Wonder what our rights are under the consumer credit act as I am still paying monthly payments?

Montly payment are usually for the aitime, not the phone. Your rights depend on whatever the t&c say they are in the contract you signed up for; different for a new phone.

You can buy a phone on the giffgaff website and pay for it monthly, it’s via a loan of some sort from a company called Ratesetter iirc.

They are the same rights as you have with the supplier. From section 75 of the Consumer Credit Act 1974:
"(1) If the debtor under a debtor-creditor-supplier agreement falling within section 12(b) or (c) has, in relation to a transaction financed by the agreement, any claim against the supplier in respect of a misrepresentation or breach of contract, he shall have a like claim against the creditor, who, with the supplier, shall accordingly be jointly and severally liable to the debtor."

In the first instance you need to read what remedy Giffgaff's warranty offers in respect of your phone's fault.

I had quite a battle to sort out my phone and sent back to them, then they returned it saying it wasn't covered by warranty then sent it back again and they finally after a lot of being fobbed off and passed between people who couldn't actually tell me what was wrong, they refunded me. I bought a Nokia from Argos and feel a lot happier
