Sounds like DJ Lottery, even though DJ Hickinbottom upheld a defence recently on here, she sounds like a person who wants to get to the bottom of the matter. So she asked questions and spoke to the Defendant despite you being the lay rep. All fairly unusual by most accounts. Not unheard of, but rare.
Most Judges never ask who was driving in these cases and plenty know that the Defendant does not have to say.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Not all that rare at all.
If the Defendant has filed a Witness Statement, that is their evidence, and they can be questioned on it by the Judge, and/or cross-examined by the opposing advocate.
The job of the Lay Rep is to make submissions on the legal arguments. The witness is the person who should be stating, and possibly being questioned on, the facts of what actually happened.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
How many times have you seen a witness asked questions, when you've lay repped, bargepole, out of interest?
Half the time or less?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Probably about half the time. But, like Henry Ford's famous saying about advertising, you don't know which half until you know which particular Judge is hearing the case.
There's one Judge at Staines who makes them stand in the witness box and swear an oath or affirmation. I keep expecting Perry Mason to rock up.

Been thinking some more on this and reflecting on the day. It definitely wasn’t a DJ Lottery, DJ Hickinbottom had the entire case load related to parking fines that day, in fact i’d applied to be heard at Huddersfield, and the case was moved to Bradford, potentially suggesting they are triaging cases and moving them to a Specialist DJ for West Yorkshire. Might be worth establishing if that is a common approach around the country.
No other DJ was hearing parking cases that day.
It also has me wondering therefore if certain DJ’s are coming on here and checking out the “up and coming” cases. Not a conspiracy theorist, but something to think about.
Another point was that HX CAR PARK MANAGEMENT LTD was responsible for 4 or 5 cases being brought yesterday morning, many more than the other parking companies (ES had one, can’t remember the others). It appears HX are particularly Litigious.
Bargepole’s description is exactly how it went- the DJ and the Claimant rep questioned my wife on her Witness Statement.
Today is a new day and I’m drawing a line under this now. Thanks folks0 -
Thanks Stevey, for fighting and trying.
So sorry there is no guarantee, and so sorry that honesty about the driver was so costly, which is ALL WRONG.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hey Stevey - sorry to hear about the loss of the case - I'm currently going thru one with the same people and same car park, but slightly different circumstances - I was wondering if you could help me out - see Private Message0
