Hi to cut a long story short im in a bit of a pickle and I don!!!8217;t know what to do. I bought a house with my husband over 10 years ago, joint mortgage split all bills and mortgage payments down the middle and both saved for deposit etc.
Unfortunately we are now divorced and things are not amicable. We have been separated for 2 years, divorced for 1 year.
When I left with the children it was agreed I would go in to rented accommodation and he would stay in the house whilst it sold. This was 18 months ago.
The house originally went on the market for £350k, we had a lot of interest and it sold within the first month with an offer being accepted at £330k. the sale fell through a week before completion as the buyers pulled out as they were sick of waiting for my ex to find somewhere to move too. Back on the market the house went. Lots more views and another offer again this time new buyers £325k, 8 weeks later same old story buyers give us an ultimatum that they will pull out unless my ex finds somewhere, the sale falls through. Back on the market again it then sells for £320k and guess what my ex cant find anywhere and the sale falls through.
I wont go into too much detail but I don!!!8217;t think my ex wants to move, purely because he now has a new woman living the house which is fine and they are enjoying the house together now. but all I want is to be off that house mortgage an deeds and my share of the equity so I can move on.
Ive asked my ex to buy me out and the answer is no, he can not afford to buy me out. The equity in the house is approx. £100k and the divorce settlement financial consent order states any equity up on the house being sold will be split out and shared equally.
He also doesn!!!8217;t pay me any child maintenance because this is offset against me paying half the mortgage payments. I don!!!8217;t get the benefit of living in that house and have to pay rent on another house so I don!!!8217;t really think that was fair but its what his solicitor pushed for. The estate agents are now getting fed up of our house sale saga and have tried to make out that if we leave to market with someone else they will bill us for finding 3 potential buyers. Its not estate agents fault they have done their job marketing the property and found us 3 buyers in the last 18 months.
The problem is that viewings have gone quiet and there is no more interest. I have suggested we stick a for sale sign back up on the main road or reduce the house price again but my ex wont agree. Im just getting stressed now and anxious because I need to move on I don!!!8217;t want to rent anymore its wasting money but I cant buy until I get my share of the equity out the house and come off that mortgage and I just don!!!8217;t know what to do.
How can I even think the house would sell again anyway if my ex wont find anywhere else to live? Does anyone know what I can do? If I have any rights? Thanks

Can you please use paragraphs. Big walls of text like that are hard to read and may put people off trying to help.
My initial thought on getting him to concentrate on selling is you should move back in, that will focus his mind.0 -
I'm thinking this might end up in solicitors hands again as he isn't going along with the promise of selling the house.0

hi thanks, do you know what if anything a solicitor can enforce?0
-
Solicitor can get him removed from the property to force a sale...be prepared though, mine took nearly 5 years from start to finish as he avoided replying to every letter and bailiffs attended a number of times.
By the time he was out every meter had been taken put due to bills not paid and there was a major leak. He also did not turn up to court on both occasions so the judge awarded him to pay all costs.
Good luck0 -

I can't even read that without paragraphs... my eyes!0

is it really worth commenting on the grammar on my post rather than offering advice?0

I don't think it's so much that people are criticising your grammar, it's more a case that seen on-screen a solid block of text can be hard to take in, especially for some people with cognitive or visual difficulties like myself.(Nearly) dunroving0 -
My apologies I'm not used to posting in forums, i didn't know people were so precious about stuff, will continue to seek advice. Thanks to those who have offered advice.0
