Trying to get a copy of my sons DLA letter from ex

Options
My son is 5 years old, lives with his mom/my ex and has (smooth Brain Syndrome/lissencephaly) in short he has very delayed development, he cant walk, talk or even sit without support or atleast someone sat with him. Which means he needs lot of special equipment, which i just cant afford and i ev looked in to charities and things like that. They all need a copy of his DLA award letter before they can even look into help for him. His mom said she dosen't have a copy of it even tho we have been asking for about a year, she just keeps making excuses not to give to me so i cant get the things he needs to be safe in my home or even take him out. DLA just say because im not on his claim i can't get access to his records. what can i do PLEASE someone help.

If she doesn't have a copy of the award letter then she will have to ring DWP to ask them to send her one out. Not sure what your others options are here as you say the DLA award letter is needed. DWP are correct you won't be able to ring to ask for a copy of this. Seems a little mean to me as this would help your son while in your care. I hope you get this sorted soon but i'm afraid i don't have any other advice for you.

Does the ex not have this specialist equipment that can be used by both of you at each others home or does it have to be installed?

If not it's pretty selfish to make the child suffer during their visits.

Taking the OP at face value, it sounds like the child's needs are being used as an excuse to not let the child visit. Which is desperately sad for everyone.
Unless I say otherwise 'you' means the general you not you specifically.
  • she does but also want give it to us due to, in her words not mine. its to big to move about

She has all the stuff for him but wont give it, other then his wheel chair, she says everything is to big to keep moving around. and he has a bee chair and standing frame. we went and brought a new bigger car so we could take the stuff back and forth.
  • We even have social involved but they couldnt care less, i think my only option is to take her to court but tbh its the last thing i want to do, because it will just send the !!!! in the air between us.Does anyone know where i stand if i did take her to court??

try again to get a copy from his mum - she will as you say have received this year's award notice in the past 6 weeks or so.

what items is it that you're wanting help with? It might be that they're readily available for less than it would cost to pursue this in the courts

OP, would your child's mum be willing to apply to the charities for additional equipment to have at your home rather than you having to do it or are relations not good enough for that to be an option? I don't know about court action, I've generally found Contact A Family a good gateway charity (in so much as they usually know where to direct you if they can't help directly) so perhaps if you get in touch with them they might have suggestions.
