DD just stopped for no reason?

Options
Hi
I was checking through my Diect Debits and just cancelling the ones which are now obsolete when i noticed that the one that pays my Council Tax each month was last paid in June 2017, it was still sitting there in the DD list and had not been stopped or cancelled by myself, and so now will cause me to owe around £1000 to them through no fault of my own...

Is there any kind of complaint to the Bank where they may give me some sort of compensation from putting me in this situation or is it just my problem and now debt

grateful for any help on this and what i should do , Thank you

Surely if they haven't been taking the money then it is still in the account waiting for them to collect? Unless of course you have spent it in the mean time and not noticed your account has had roughly £100 a month too much available for you to spend.

There is no way the Council would not have written to you demanding you pay up if they had not received payment since June 2017.

So they surely must have received payment from somewhere. Did you perhaps set up a DD on a different account so that the bank still has the original one recorded but the Council has taken payment from elsewhere?

Totally agree with you that OP would have received arrears letters if the council tax had not been paid. This years council tax bill was sent out in March and would have stated any arrears on it.

My understanding is that in relation to direct debits it is the company who is due the money that puts in the claim as opposed to standing order where you set up with your bank to pay a set amount each month. If the council have not been claiming the money than it should still be in your account for them to take.

Check through the bank statements and see if the money has been taken - I had a DD once that insisted it had not been taken for months, according to the date shown, yet it was being happily paid out each month.

If payment had not been taken since June 17 and no money was being received then it's highly unlikely you would not have received a court summons and a liability order by now (although I have seen odd cases in the past where council tax accounts have been held and no documents had been issued for over a year...).

Simplest answer is to call your council on Monday to check or set up an on-line billing account with them via their website (most will allow you to).
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

My DD's for council tax have been going out of a TSB account without issue for over two years now.

Yes, but some account info is still showing incorrectly.
It may be that the payment has been made fine, but the info on the ddr page isn't correct

Assuming you are correct and what others have suggested hasn't happened, then no, there is no compensation due. What loss have you suffered? You owe the same £1,000 you would have paid anyway and now you perhaps even have a few pounds of interest to show for it.
  • Thanks for all you suggestions and help ...
Well when you have a wife and Kids £100 disappears very easily, so no i haven't noticed any extra money lying about unfortunately :(
I checked through my statements and no money has been paid out by the amount I would expect from any of my accounts.
And No ... I haven't heard from the council as you would expect if there was a problem in fact i wish they had so I could have known about it and dealt with it straight away .
I did phone my bank today (Lloyds) and they said the DD is still in place but for some reason no call for the money had been received for it ...
So I will contact the council tomorrow ( dreading it :( ) to see what they say ... I will report back when i have an answer , just incase its helpful for anyone else
    Thanks again :)
