You're going to need to give us some more detail. Course? Provider? Website? Otherwise we're just guessing.

The terms and conditions are readily available on the website, so I don't think claiming you weren't informed of them is much of a defence. What is it about the information on the site that is misleading and why do you think they have mis-sold the course? You will need to demonstrate this if you are to secure a refund of your deposit.

I assume you haven't contacted them to ask for a refund?

Am I not entitled to 14 day cooling off period??

I told them that I needed a level 4 accredited course to perform this treatment in my borough. In an email they told me that their course is accepted by ALL local councils (you have to obtain a special treatments license) but I have now found out that it is not and many London boroughs refuse them. Although their course is level 4 it!!!8217;s not accredited by the body that ALL boroughs accept.
On the cooling off period, not necessarily. When you're buying a service to be provided on a specific date, eg hotel bookings, flights, car hire, etc then you have fewer rights. If your course is on a set date then it would seem to fall into that category.

The crux of your argument seems to be about the email exchange, which I assume took place before you placed the order and paid the deposit? You need to be precise with your detail here. If you just told them you needed a level 4 course and that's what you've ordered, then they haven't misled you or mis-sold the service. If in addition to that, you asked them whether their course was accepted by your borough and they said yes when the answer is no, then you have a right to a full refund.

The wording in your last post is a little unclear. It sounds to me that you have found out that not all boroughs accept the course, but have you established that your specific borough doesn't accept it?

What exactly did you ask them and how exactly did they reply?

Ok, I understand, but it looks like your argument is that because you've found one borough (not yours) that doesn't accept the qualification, the course has been mis-sold. That doesn't look like a good argument.

They say the qualification is "recognised by all.....councils to be of a very high standard". That's not the same as them confirming the course means you'll be able to practice in every borough. In fact, it means pretty much nothing at all. Unless you specifically asked them to confirm that the qualification would enable you to practice anywhere, they haven't mis-sold the course and after all, the course does meet your needs where you intend to practice. No training provider is going to guarantee that a qualification will be applicable anywhere for ever more so it's unreasonable to expect that. They would presumably argue that it is up to you to do the checking that it is exactly what you require before you booked and that's a fair point.

    I don't think you've got a case for a deposit refund I'm afraid.

Just to point out that this is a business to business transaction and therefore your rights are far more limited than those for an individual.

So you're paying thousands to train to perform these treatments solely on yourself? That's obviously not the case from the information you've provided - you're going to be treating others in return for payment. A business.
