    1- The Protection of Freedoms Act 2012 has not been complied with.
    4- Furthermore, it would appear that, on the date stated by the claimant that the meter itself was not operational. Whilst I am able to confirm that I would have been at the hospital at this time, I cannot confirm if I was driving as I did not always do so due to the treatment required. I am however in possession of a photograph, which I believe to have been taken on the date in question clearly showing a notice posted on the machine with appropriate logos for the Claimant that reads "Out of order. Free parking until further notice. No fines will be issued".

    I think your defence reads like someone who is trying to hide the fact they were driving, when in fact a better defence would be to defend as the driver so you can say CONFIDENTLY that the machines were out of order and that the Defendant took a photo.

    Hi guys.. quick question but submitted the defence after the tweaks here and pepipoo and got the letter from the court acknowleding. A few days after BW sent a letter stating they were continuing and enclosed a photocopy of their completed DQ. This was marked that the fee was not enclosed.

    Any idea when I should receive my own S20 directly from the court?

    I am but either blind on my mobile or didn't see about when DQ gets issues directly by the court . Am I right to assume it's when BW pay the fee?

    In Bargepole's post, linked from NEWBIES post #2, it says:
    4. After sending off your Defence, the Northampton Business centre will send a copy to the Claimant, and then send a Directions Questionnaire (form N180) to both Claimant and Defendant.

    Loadsofchildren123 says something similar, also linked from NEWBIES:
    3. Court looks at claim and defence and makes a provisional allocation to the small claims track and sends the parties a Directions Questionnaire.

    Outcome of this one. I've just telephoned the court, and BWLegal did not send them the DQ, or pay a fee. The case has now been stayed, and they will need to pay £100 to apply for this to be lifted.

    Poor conduct of them to send me their copy of a DQ alongside a letter staying they intended to proceed. There's not been any letter of discontinuance at all either. I'll have a read through the forum over lunch for next steps, but in case it's not readily available I assume complaints should be made to organisations with oversight of BWLegal?

    TPS are on a loser whatever happens now

    Is it the food they eat, too much booze, high on drugs
    or just plain stupidity
