Are letting agents obliged to do ‘assignment of tenancy’?

    Well you don't have to give him his full depsoit back! If the house and garden when he leaves are not in the condition they were in at the start, you deduct what you all agree is fair!

    But if you are planning to leave yourselves in 2 months, then the simplest solution is to leave the tenancy as it is for now.

    Go periodic. No cost. No paperwork. No inventory. No deposit return.

    In 1 month you serve notice (correctly!) and a month later you leave.

    If deductions are made, the 3rd guy will suffer as much as you, so perhaps he'll be incentified to come and help you both clean?

    If no deductions are made, it's only 2 months he has to wait for his deposit.

    What is your relationship like with him? Is he likely to demand his deposit back when he leaves at the end of the fixed term?

    We are all friends, been friends since uni (years). But she wants her name off the contract, we are unsure when exactly we want to leave.. I!!!8217;m lookiy to buy a house and my other friend is being interviewed for jobs in London. The leaving tenant just wants her name off the contract. Does it matter that heR name is still on it even though she!!!8217;s living in a differeb part of the UK til we all vacate?

    Legally it does not matter.

    To you, it does not matter.

    To her - it matters! If you fail to pay the rent, she can still be sued for the arrears. If you cause damage, she can still be held liable. So long as she remains a tenant, she is liable..

    I!!!8217;m sorry if I!!!8217;m repeating myself a lot but just trying to come to terms with all the tenancy laws, I want to make sure I!!!8217;m understanding it right as the last thing I want to do is do anything illegal. We were previously going to swap leaving tenant for incoming tenant but realised obviously that it!!!8217;s more difficult to do that than just continuing with current tenancy (her not living there but us 2 still do but she remains on tenancy) for short while and just ending tenancy in a few months when we all vacate.

    All I wanted to check and make sure is that by doing that we are not breaking the law at all. Means I can explain this to my friend bcos the main thing she is worried about is that we!!!8217;re breaking the law, not that she doesn!!!8217;t trust us two to cover her share of the rent.
