  • You don't have to sign or leave in May. You can not sign and see if the LL/LA make moves to evict you. Before they can go to court they'd have to serve 2 months notice with a S21. So that's two months. Then they have to take you to court for a possession order and bailiffs warrant before they can 'force' you to leave the property.
    This will take at least an additional 2 months, possibly longer depending on court wait times.

    Hopefully by then you'd be moved out.

    Or they could just not bother, and you (being now on a periodic tenancy) just have to give a months notice when ready to leave.

    If you read around on the forum you will see threads about this.

    You've chosen to deal with the EA rather than the vendor herself.
    The only person you should actually believe is your solicitor. You're paying them. The vendor and the EA will LIE.

    I know it's not what you want to hear, but you probably haven't bought many houses before. I am not saying all EAs lie all the time. But you'll have a 50/50 chance of anything you hear come out of their mouths being a guess or a lie. They're better with things written down.

    I would, personally, call the vendor and explain exactly what's needed, and if it's delayed further it will cost you money and you may need to pull out.

    As you can imagine though we don’t want the stress of evictions and disagreements with landlords hanging over us while we wait for her to make up her mind. She sold it under the terms of chain free and I made it clear in my offer a quick sale was part of the offer. If she’s changed her mind then I’d like her to be upfront about it. My partner shouldn’t have to wait for an eviction letter to land on his door and just hope she will move before action is taken.

    As I said before it giving them till Tuesday to confirm wether she is chain free or not and at that point I will be looking at other properties.

    My solicitor is now dealing with it for me, I realised the EA and vendor were given half truths very early on so I contacted my solicitor and asked her to chase the matter and find the truth out. I don!!!8217;t trust EA as far as I can throw them, they are salesmen at the end of the day. They don!!!8217;t want to say anything that will make me pull out of the deal but ironically in doing that I!!!8217;m getting closer to doing it.

    It!!!8217;s my partners rental and it runs to every twelve months. Which ends in May. He would either have to sign another 12 months or give notice to leave.

    As it is a 3 bed with all the his plus the new houses furniture in it it would be extremely costly and time consuming to move a lot of it into storage and then have him (and my two step sons) stay with us in our small house while we wait for our vendor.

    And If the vendor states they are chain free and a ready to move when the buyer is then It!!!8217;s not my fault she lied and doesn!!!8217;t want to move in with the daughter while she searches for a new property. She!!!8217;s not saving me from any mistakes.

    Also, he doesn't have to sign another contract, the tenancy automatically becomes periodic if he doesn't.

    Little point creating conspiracy theories. Set out your own demands. If they are not met move on to something new. There'll be lots you'll never know (as it's none of your business).

    With respect, you shouldn't have given notice and moved out of your rented place until after exchange. Literally anything could have happened to delay or cancel the sale.

    Its not the vendor's fault you jumped the gun, why should they make themselves homeless to save you from your own mistake?

    I didn't really have a choice because I was in a 6-month contract and it was either hand in my notice or sign on for another 6 months and be financially responsible for 2 properties simultaneously. I don't feel as if I "jumped the gun", or made a mistake, as the seller was adamant all along that she wanted as quick a sale as possible, and was selling chain-free, then changed her mind at the last minute.
    I know that these things happen, and I knew there'd be a possibility I'd have to couch surf or find a short-term let as nothing is concrete until exchange, but it's not going to stop me from grumbling about it :-)
