IAS appeal dismissed. What to do next please?

My mother parked her car in Iceland, entered her registration number, paid for her ticket and went about her shopping. She returned to her car within the allotted time and left as normal.

Approx 3 weeks later, she received a PCN from Excel Parking stating that she had parked without purchasing a ticket. She appealed this through their website, attaching the relevant ticket as proof.

Excel replied to her stating that the registration number on the ticket did not match her car and as such either had to pay £60 or appeal through IAS.

On checking the parking ticket that she purchased, she noticed that the registration number was nothing like hers infact it was an unusual number consisting of 2 letters, 2 numbers and 4 letters eg AA11BBBB so she appealed through IAS asking the following:

1. Why did the machine issue a ticket with a registration number that was invalid? Please check the machine.
2. If someone previously entered that combination, why did the machine retain the information and reprint it on another ticket? Again please check the machine.
3. Please check the CCTV so that you can see that a ticket was purchased In good faith.

She has now had a reply from IAS stating that the payment systems were all working correctly and that she simply made an error entering her details. Therefore the appeal has been dismissed and she is to contact the operator to ‘make payment of the charge’.

My mum is now considering paying the charge as she is an elderly lady who cannot afford to pay for legal advice. Would someone please be able to advise me on this matter as I really don’t know what to tell her to do next.

    The IAS will nearly always find against the motorist. It was a waste of time appealing to them.

    She will now be bombarded with letters from debt collectors. These can safely be ignored.

    If she gets a letter titled "Letter Before Claim" or similar wording then you need to come back for further advice. Do not start a new thread, stick to this one for continuity.

    Tell her not to panic about debt collectors letters. They might seem scary but all they can do is write.

    They have 6 years to start legal proceedings.

    In addition to ignoring, you should also contact the Landowner and ask them to cancel and furthermore, write to your own MP to explain how "corrupt" the system is.

    Were any of the letters and numbers correct?
  • Thanks everyone. I'll tell her not to do anything at the moment. My apologies Quentin. I did read the FAQ but on going back to it, realised I didn't read it fully. Castle, I'll check to see whether mum spoke to the Landowner. With regards to the Registration Number, none of it was anything like my mums unfortunately.

    Unfortunately, you are dealing with two scammers ...
    EXCEL and THE IAS

    This problem is common whereby the systems being used
    do not talk to each other and if they do, it's often in
    a forked tongue.

    Excel are well aware that ANPR systems are very dodgy
    but they still try to scam people out of money

    The IAS is a disgraceful scam set up by the very dodgy
    solicitors ... Gladstones

    Whilst we can understand your mum wanting to pay and get
    rid of this scam, if she does, it will support the scam so
    Excel and the IAS can continue to steal and rob from others,
    especially the elderly

    So the IAS claim the machine was working correctly.
    That is complete rubbish, how do they know, did they
    get the machine checked by an independent company ?
    Of course not so this a fake statement and a lie.

    IAS: ... Excel are your machines working correctly ?
    EXCEL ... YES ?


    All that has happened is the IAS are backing Excel
    who pay them a membership fee to do just that.

    You therefore require the IAS to confirm their statement
    and prove the machine is correct.

    Scammers do not respond as in particular, the IAS will
    have no answer and no proof. But there are other ways
    to skin a cat and in the IAS case, skin a rat .....

    A wonderful thing happened last week.....

    On BBC Watchdog last wednesday the subject was
    ANPR and their reliabilty and a company called Parking Eye,
    a similar scam outfit to EXCEL, came to media attention
    once again.

    What we have known for a long time, ANPR is not a reliable
    system and on live TV, the CEO of the BPA who are an opposite
    number to the IPC who RUN the IAS, admitted that ANPR
    is not 100% reliable

    As said, what happens next is so called debt collector
    letters instigated by EXCEL.
    PLEASE UNDERSTAND that all debt collectors involved
    in the parking industry are 100% POWERLESS and there
    is nothing .... 100% NOTHING they can do.
    These idiotic debt collectors normally add £60 for their fee ?
    It's a try on by yet another scammer to completely ignore.

    After you have thrown these letters in the rubbish bin and
    TOTALLY IGNORED THEM, just sit and wait

    If the Excel scam continue in their normal manner, you will
    hear from a legal called BWLegal making threats about court.

    NOW YOU HAVE YOUR CHANCE AGAIN ....
    As it is now confirmed that ANPR is not 100% accurate,
    then proof is required that in your case, the machine was
    working correctly and not heresay

    Without proof of their claim it may take a judge to ask
    the same question of Excel and probably to whoop
    them yet again
