How can Vodafone flout the EU roaming laws?

    Obviously there are differences of opinion on this. Both sides are arguable. We won't have definitive unless this goes to court.

    My opinion is that Vodaphone is acting illegally, but they could have got around this by setting up a subsidiary to offer these tariffs.

    It clearly states that if an operator offers roaming it can't charge extra. Vodafone offers roaming and charges extra.

    But feel free to make yourself look simple by arguing otherwise.

    Be very careful, it is possible to libel a company. There is a huge difference between avoidance and evasion.

    A regulation is a legal act of the European Union[1] that becomes immediately enforceable as law in all member states simultaneously.[2][3] Regulations can be distinguished from directives which, at least in principle, need to be transposed into national law. Regulations can be adopted by means of a variety of legislative procedures depending on their subject matter.

    They've not been incorporated into UK law because they don't need to be.

    You have been confused by the "not charge more" requirement. This is a per customer requirement. A customer who goes abroad cannot be charged more than if that same customer were using their phone in the UK.

    The regulations say nothing about a customer with roaming arrangements paying more for all of their calls (whether roaming, or in the UK) than a different customer without roaming arrangements pays for all of their calls.
