Vendor insists on selling her furniture

    I'd says shelves and firepalce should be part of F&F. and unreasonable to remove.

    Our vendor was like this. We just said no. And also reduced the price after the valuation came back lower, though still paid over. Since though a 13.5K drop would make them sulk.

    The left everything they tried to sell! Removed shelves though. But saved me a job there!

    Thats a good idea except the EA works for vendor which might not work in your favour (in other circumstance). Plud its in their (EA) interest to get things moving unfortunately some EA's are either just plain & simple lazy or they try to deceive buyer by hiding information at until its too late. If you have direct contact with the seller then you can get clear picture of where things are. But it is two edge sword!

    Like Eddy says above, EA works to make money. Especially at this stage, they have done the hard parts (quoting, photos, rightmove ads, viewings, negotiations). They are on the home straight to make £3-10k (depending on % charge). If they dreamt for a second this sale was going to fall through they would be all over it.

    I agree in other circumstances they may hide things and that their motivations normally align with vendor (both want to sell house)
  • Certainly deal with the EA; you have to always be aware that they are on the vendor's side, but they should provide a dispassionate and sensible channel of negotiation.

    Obviously, don't trust them with information they don't need to have and don't expect them not to try and screw you over if they get the chance; that's what they are there for. But if what the vendor is saying is deluded and insane, it's also the EA's job to communicate that to them in a better way than maybe you can.

    You can, for example, tell the EA the furnishings are awful and you would have to be paid to take them away. This establishes your position and it's then their problem to make that clear to the vendor in a way that isn't going to upset them.

    While buying his house a colleague at work was constantly hassled by the sellers regarding their "real wood blinds" that the owners had spent a lot of money on only recently.

    My colleague politely replied that unfortunately they were very dark rosewood so would not match their other furnishings and were just not to their taste.

    After rejecting request after request to purchase them he finally snapped in a meeting and replied calmly (with a phrase which is now in common use around our office) of "Look, for the last time, the blinds are a f****** non-starter, OK!" The seller replied with"OK, but you won't call my bluff so we'll be taking them all down". He replied, "Great, saves me a job doing it when we move in". :p

    Despite annoying the seller (and seriously embarrassing his partner who was with him in the meeting), they still completed on the house and the seller had indeed removed them all when they moved in.

    Almost two years later he dropped off some post that had arrived for the seller at their new house, the seller was in his garage when he arrived, and on the floor were all the blinds, covered in dust and cobwebs and of no use to anyone whatsoever.

    Many sellers can take it personally when their sense of style or taste is dismissed by someone else which can cause them to lose objectivity. Hopefully the EA, who's primary interest is in the sale completing, will be able to help them find it again!
    • The rich buy assets.
    • The poor only have expenses.
    • The middle class buy liabilities they think are assets.

    A fireplace is part of fixtures and fittings as is anything eg shelves, kitchen cupboards, fitted wardrobes that would not fall off if you turned house upside down. So just watch and see what the fixtures and fittings form says when she has completed it and it's in the possession of your solicitor.
    Just be firm yet polite otherwise you'll end up paying to get rid of her stuff. If it's so good why doesn't she want it, hmm?

    The vendor might be paying them, but they tend to speak to both parties. I dealt far more with my vendor's EA than mine, and my EA seemed to be far more sympathetic to my buyers than me!

  • This is why unless its a private sale (or I assume Purplebricks / Yopa etc) its all done though the estate agent only and there is no contact with each other. It then saves any of this pressure / hurt felling nonsense.

    It sounds like they dont want the stuff but dont want to just leave it either. I also dont get people who want to charge for carpts / blinds etc. Unless you are moving into an identical shape of a house there is a good change they wont fit...

    Again, an instance where adoption of standard clauses forming part of the buyer's offer would have avoided this situation...

    Standard Scottish contract clause (agreed to early in the process, by acceptance of offer including such clauses);

    1.3 The Seller warrants that at the Date of Settlement all items included in the Price are owned by the Seller, are or will be free of all debt, and are not the subject of any litigation.

    Just say no and give them 7 days to agree otherwise your looking elsewhere.
