  • So making an interim payment to the themselves and one other beneficiary while leaving the share for refuser is legally possible and won't be looked down on when they pay the share into the court. I am correct?

    Yes. Especially after all the attempts you've made to get this beneficiary to accept their inheritance - it would be really bizarre for him to claim in court that you should have given him an interim payment when he's refusing to accept his inheritance.

    I agree. But because if he was at court it would probably be a case taken by official representatives of him.

    The biggest fear is that the court will say that they need to track him down personally not just send letters via his local authority who say they pass them on. They 100% opposed to doing that.

    Despite the efforts everyone has made he will get very short shrift if he decides to take court action. The judiciary don’t take kindly to idiots like him. He will find it hurts his wallet. I would leave matters as they are.

  • What I am concerned about is if it turns out the local authority have not properly passed the letters on or he wasn't well enough to receive and understand them. Would a court accept three letters sent via a local authority as enough searching.

    The ececutors have taken reasonable steps to locate him. That is all the court wil require. If you take a court action the court just send a letter to their last known address and that is deemed to be sufficient. Forget about it/
