Should i accept 50/50 or go to court?

Sorry, I didnt really post much about the accident as i have already made about a million threads on it just wondered the 2 questions about the court procedure, as in if it goes to court do they just decide one is at fault or can they also decide 50/50.
And because i have a claim going for losses and PI would it be safer to just go 50/50 if there is a chance of them deciding it's my fault.
I'm just looking at the worst case senarios to get a better light on things seeing as i'm so 'uneducated'.:j Baby boy Number 2, arrived 12th April 2009!:j0 -

As someone who has been and is in your situation, obviuosly if its going to court then you need a solicitor, surerly the insurance company is sorting that out.
This is my thoughts etc - as long as you are sure that you are not to blame let it go to court, it could be scare mongering tatics from the other side, basically there are people who claim whiplash etc who are not injured so they make all claims difficult.
If it goes to court the magistrate will decide, basically a magistates court is based on the probability of an incident happened, so as long as your telling the truth, go in there hold your head up high and tell the truth.
re your PI claim, based on how the court case is sorted, then say your
25% responsible any claim will be less than 25%
Why should you lose your no claims when its not your fault, theres the possibility that they may pull out b4 the court case, get hold of your insurers and see what they sayxx rip dad... we had our ups and downs but we’re always be family xx0 -

Just to clarify a couple of points to save the OP going down the wrong track.
The case will be heard in the County Court. This is a civil court. Magistrates courts are for criminal matters.
Normally the court will decide on liability and quantum (value) of the claim at the same time.0 -

Why start so many threads? Perhaps 1 or 2 would have sufficed ....with the full details of what happened....including what led up to the 'accident'.
I made a thread on the day it happened in the arms, no questions just a sort of telling thread.
Another one about buying back a written off car, another about compensation and one about an osteopath, so whilst they are about the same thing, they all have different categories, also this is over the space of 2 months.:j Baby boy Number 2, arrived 12th April 2009!:j0
