Napier Parking County Court Claim

once they paid the court fee you should have been notified and a local court allocated
the local court would have sent you the directions including the date of the court hearing and the date that the WS and evidence have to be submitted by, usually a few weeks before the hearing
so unless this house move or renovation didnt have redirection in place, you should have done all of this by now, but it seems you took your eye off the ball, and they didnt
ie:- your WS and evidence should have gone in a wekk or mkore ago, plus you should now be onto your skeleton and costs order etc
and I do not believe there is anywhere "online" where you can view whatever it is you wish to view
it was never going to "go away", no idea where you got that from0 -
Are you saying you haven't submitted a Witness Statement and the court date is a week away?0
-
Yes exactly that0
-
Yes, I knew the court date was coming up, it’s in my diary.
I had a letter from the judge that was damning against Bw Legal, basically saying they had till a certain date to sort their bits out or it would be thrown out.
This was the last I hear until the witness statement from Bw legal dropped into my inbox last week.
So now I’m a week away from court and I’ve not filed any witness statement or anything apart from my original defence.
So due to my own ignorance am I royally screwed? Or do I have an opportunity to do anything?0 -
phone the local court tomorrow and find out if they sent you the paperwork etc0

Hmmm...what did you find when you searched the forum for something obvious, like, say, these keywords:
NEVER TOO LATE WITNESS STATEMENT
I just did and found one of several like this:

Please stop flailing - stop assuming you are screwed - and just get on with it, like they did. They still won.
Publican Paul on pepipoo won last year after filing a WS with 2 days to spare.
Loads more I can't recall, this is more common than you think so just do it (WS and evidence, in person to the Court, in a ring binder tomorrow if you can get this done tonight). Then email BW Legal's version of everything and print out the SENT item email, and add that to your own file of copies of everything in case they pretend you didn't serve the WS & evidence at all.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok, Spoke to court, said I can still send witness statement, according to their records they have not received a witness statement from BW Legal either, but I have received a copy via email from BW Legal.
But I am really struggling with the witness statement, having trawled through loads of posts and searching for something similar, can't find a template suitable.
Details of case;
Ticket issued over 1 year ago.
My only reply to BW Legal has been via court defence, I did not appeal or make contact before the court process
Notice to keeper fixed charge notice
In their witness statement there is a diagram/map which shows entrance sign, and terms and condition signs in 5 or 6 locations.
reason for issue: failure to display valid ticket observed for 6 minutes
£90 penalty reduced to £50 if paid within 14 days
There are 11 photos of the vehicle I own timestamped
I am thinking my only argument is the notice to keeper argument as there is no evidence of myself there and there is one other driver on my insurance policy.
Is there a template for this only please?
I am away until a couple of days before court, so I am unable to visit the car park to take photos etc
Any other advice would really help0 -
Youre writing the FACTS AROUND YOUR CASE
There is no template, because teh detail of the facts will be different.0
