No, an application for a Civil Restraint Order cannot be dealt with at District Judge level.
It has to go to the Circuit Judge for that group of courts.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Hi guys,
To confirm I have now received in total:
- A new claim form for 3 PCN’s (2 dated on the same date which is impossible)
- A letter from Gladstone’s for 1 of the dismissed claims stating it is the amended witness statement to be placed in the court file in readiness for the prosposed reallocation of hearing
- A further 2 letters dated on the same date from Gladstone’s received 2 days apart, containing the SAME claim number which was also dismissed at the original hearing.
I have completed the AOS online so this gives me another 14 days from today.
From reading the above posts, the counter claim seems like a fairly lengthy process. Would it be easier for me to just go ahead and defend the claims again since I already have a defence ready?
*** Just to confirm, the 2 of the claims which they have resubmitted witness statements for, they can be defended on the basis that they have already been dismissed, is that correct?0 -
Why are you even entertaining the idea of 'defending' the struck out cases?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Apologies, how would I go about addressing these claims when I receive new hearing dates for them?0

Because they have submitted Witness statements again for the dismissed claims? One of which states for proposed reallocation.
Or will the courts see that these claims have already been struck out?0 -
They will if you write to the Judge showing him/her what this Claimant is doing to you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok so just right a formal letter to the judge explaining what they are doing?
What is the easiest way to find out which judge heard the previous case? I believe the case was reallocated to a different judge on the day but I can’t recall his name :cool:0 -
No, write a formal letter ....
(I don't wish to seem unkind, but it's important to get this right).0 -
:wall: can I use that post as my evidence showing the distress they have caused me?
Apologies for the typo Typing too quick.
