    If the council doesn't take action then it's irrelevant, as that's the only scenario in which a claim is made.

    If the council does take action, then the question of what prompted them may well be asked.

    Thanks both.

    The lack of building consent certificate is bothering us. on one hand we believe the property to be structurally sound but we would need a structural surveyor to satisfy our mortgage company. I am reluctant to pay for one because I think they can be a bit vague and if there are issues I don't see the seller agreeing yo rectify them.

    Also surely without the consent it is worth less than what we are paying

    Bear in mind that if you ever come to sell the property in the future prospective purchasers will have similar concerns about the same issues.

    It seems we have had a bit if luck obtaining the building consent.

    The buyers solicitor wrote to say the client won't get the completion certificate. But this wasn't the advice the client gave. The seller contacted us saying there were willing to speak with the local authority but were adamant that it had been completed previously. Today they contacted the local authority and spoke to the original inspector who said they remembered going to the house and signing it off but doesn't know why it isn't recorded. He has agreed to come out and have another look. Fingers crossed it goes smoothly
