Private rent with Scottish Trust Deed

Hello all,

I hope you can provide me with a bit of advice.

Basically last March I entered into a Trust Deed Scheme. The scheme was in my name only, not my Wife. My wife is a foreign national and has lived in the UK for around 10 years however since she has been here she has never had any credit, therefore she effectively has no credit rating.

We currently stay in a privately rented property which we rented pre trust deed however the landlord has now advised us that he intends to sell the house in the near future.

Now I am starting to panic as we wont be able to buy a house anytime soon and furthermore I know that credit checks are carried out via private rental agencies.

We currently have our name on the Council housing list and with the local Housing Associations, our son is Disabled therefore I am hoping they may be able to offer assistance.

However my query is whether any private rental agencies would allow me to privately rent a property if there is an issue with your credit rating? I have never once missed a rent or Council tax payment in all my years of privately renting a property therefore I could get a reference from my landlords. I was hoping that even having a parent as a guarantor would be able to assist our case.

I am aware that the next step will be discussing this with rental agencies direct however before I have a chance to do this I just thought I'd ask if anyone had come across a similar situation?

    Guarantor or offering to pay 6 months rent in advance are the usual ways of bypassing the need for a credit check. Dealing direct with a LL rather than an agency may help, but you'll probably need to look for properties in different places to those where the agencies advertise.

    Fine: Landlord can sell, no problem, but you do not have to leave and your tenancy does not end: Even if new owner is outside with huge removals van, 3 bonkers kids and screaming hubbie: Thanks to the Leases Act 1449.

    So until & unless landlord issues the correct notices (many are invalid..) you don't have to go anywhere...

    Presumably you have read, carefully your council's housing allocation policy: e.g.
    https://www.highland.gov.uk/directory_record/619277/housing_allocation_policy/category/461/housing

    What makes you think YOUR SPECIFIC circumstances give you priority over everyone else on the housing waiting list? (Which is what you will be arguing about with council...).

    If you haven't read the policy carefully, strongly suggest you do so.

    Our son does have disabilities both physical and mental and we have received support from various specialists who all state that we would really benefit from a change of property for various reasons. The Council have given us priority points based on this.

    What indication did they give as to when you'd be offered a new home? If nothing said to you, ask... Some councils it can be years or decades...
