    I'm not trying to communicate with them; haven't used them for about 3 years since they refused to pay up on Topcashback. Their cashback deals (my speciality) have also been rubbish for about 5 years. However, I always got my money even when they played dirty because I enforced my side of the contracts when they did - and guided a number of others I order for to do the same.

    Took some legal advice on this and it confirmed that a contract has indeed been formed and so will be taking this further. It is worth formally complaining to them and asking for compensation and details of their ombudsman scheme and also reporting them to trading standards for misleading consumers and breach of advertising regulations. If you do accept the refund of money make sure you state that it is not in full and final settlement so you can pursue other options.

    I'd ignore all of that. A proper and convincing LBA is much more likely to produce a result.

    The problem with legal action in this instance is that you have to prove loss, but you are in fact looking for specific performance of the contract. That may be more difficult in the small claims court and I'm not sure what you'd claim for - perhaps specific performance or the difference between the total cost of the contract you agreed to away from the cheapest available alternative. Further legal guidance would be good.

    To.mobile junkie, is there a template or any advice on writing a convincing lba on.this matter as am getting the same reply of them over and over again! Many thanks

    Only the link I posted earlier. Although geared to money owed, you could change the content to the extra cost of an alternative purchase if they don't provide what they contracted to. I would state that they are bound to the contract offered since you accepted and they took payment. Give them 7 days to comply and state that should they still refuse you will commence proceedings against them for the extra cosat, plus court fees and incidental costs and statutory interest. Send it to CPW T/A Mobiles.co at CPW's registered address and send a copy by email to Mobiles.co.

    Hi there

    I haven't really got anywhere with this. The company are not interested in resolving the matter and as you mentioned just provide standard, unhelpful responses. I am advised that legal action would probably only result in it getting back the money it has debited so far. The CAB were not great either - they suggested just taking the refund. The other option would be to persuade the company to honour the deal which we know is not going to happen. I asked the CAB to refer to Trading Standards and they will but said it will only take action if it receives more complaints from consumers. So, all in all, very disappointing - but I will not touch this outfit or its parent company ever again. Did you get your money back?

    Not tried getying a refund since I was put on hold for over 30 mins last week, am in the process of writing an lba so will see how it goes although will agree with you that am very reluctant to use this company ever again !
