LBCC Parking Eye

Firstly, thanks for all the advice on this site. It's a very helpful resource.
I received a 'ticket' from Parking Eye a few months ago after my car was photographed in one of their carparks in Stockton-on-Tees after being there for a quarter of an hour without a parking ticket.
I've followed all the advice on here and didn't reveal the driver's identity. I appealed on the grounds of grace periods and signage to POPLA but my appeal was rejected.
I didn't pay up afterwards and was starting to think Parking Eye had left me alone until the LBCC dropped through the post last week. I've read through quite a lot of information on the Sticky thread and on other sites and it looks like there's quite a battle ahead if I want to go all the way to court.
To be honest, I'm finding it quite stressful dealing with it and spending hours reading up on how to challenge Parking Eye while ignoring my wife and children!
Is it possible to make a Without Prejudice Offer to them at this stage or would you advise against it? I absolute hate these bullying b@st@rds but they're winning the war against me.
Thanks in advance for any advice.

No one here will advise you to make an offer
Deal with this a step at a time
The newbies faq thread covers this from lbcca to a hearing
Edit your post to remove details of who was driving!0 -
Is this connected with your previous thread? If so, why did you halt communication with the forum a few months ago - we might well have helped you to get rid of this then.
Now you need to prepare for a court battle. As advised by Quentin - the NEWBIES FAQ sticky, post #2 is your guide from here on. Read it often, and carefully. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Sorry, I'm not sure what you're referring to?0

We mean please continue where you left off, not on a new thread. We prefer and find easier, just ONE thread, even though there's been a huge gap:

The LBCCC is a chance to get it cancelled, with ParkingEye.
Think - what can you tell them by email that will make them stop? Was the driver picking up a disabled person? Has the landowner been contacted to get them to cancel it?
email PE and keep up the email tennis!
enforcement@parkingeye.co.uk
and rebut the case or make a £50 offer if you want, headed with this:
WITHOUT PREJUDICE SAVE AS TO COSTSPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you. Sorry, I hadn't realised I should have continued my original thread.
It's difficult to know who the landowner is as it's a private car park but not owned by a store of any type.
If I email PE with any mitigating circumstances, wouldn't that be a possible admission of who was driving?0 -
If they sent the NTK within the 14 days and if it had the POFA words in the back, you can't win by saying 'no keeper liability' anyway. So unless you do have a non POFA NTK, sent late, you may as well say who was driving when playing email tennis trying to steer them to cancel or to consider your offer.PRIVATE 'PCN'? Ok, that's helpful. Thank you. I will post any updates (on this thread!)0

Hello
I sent PE enforcement an email explaining the circumstances behind the alleged infringement and I have received back a standard response.
I don't seem to have permission to post a link to the photos of the letter but the crux of it is that 'you dispute the outstanding sum. We have enow reviewed your correspondence but it is our position that the Parking Charge remains due'.
Should I reply by email and ask for them to comment on the specific points I raised in my first email?
Thanks again0 -
You can try, though they do issue court claims, so the LBCCA wasn't a "try on"0
-
Thanks for the reply.
Does this mean I have exhausted all administrative options before the county court proceedings are issued?0
