Are you really saying you have managed to get this far - Acknowledging Service, creating a Defence, completing your Directions Questionnaire - and allowed six months to pass, without finding the NEWBIES thread?

I’ve found the thread regarding court but my main defence is regarding the Phone&Pay app not working. I have a print out which shows the transaction for me parking, but I don’t have much else to use as evidence.

Can I not use the defence letter I sent on 8th April which is posted on here, along with the payment printout?

Also can I email my defence and witness statement to the court & claimant (I can’t find any info on whether or not this is okay).

I’m aware that I’ve come this far but I am up to my neck with work and in the process of moving hous so have barely any spare time.

NO.

The NEWBIES thread second post, UNDER the AOS and defence info, gives you:

- Examples of Witness Statements, and

- An example list of 'evidence' people should think about using.

Why is this so difficult for people? I genuinely do not understand as you could find this in a split second, as long as you are not using a phone.

If you can't actually see the wood for the trees, why not just click/hold down control (or 'command' on a MAC) & F and put in 'Witness Statement' when looking at the NEWBIES thread, and your PC will find the section!

Like with any document, Control & F finds a word...shows you the section.

I posted my witness statement and evidence to the claimaint and the court. As I previously stated I didn't have time to structure a good witness statement and have a lack of evidence.

Obviously my main argument was I couldn't pay for the parking within 30 minutes due to an eroor with the payment app, but I didn't have evidence of the app failing, so wouldn't be able to prove that at court.

CEL are offering £100 to settle this instead of £328 they previously claimed for.

I have come this far so don't want to just give up on it now, but I've just started a new job and moved house and this has been going on for so long so would be eaeier for me to pay and it be settled.

Ayone got any useful advice?

You have your own witness evidence, you mean. You keep forgetting that is evidence.
Of course it is easier for you to pay. But think of it this wya - if CEL werre confident, why are they asking for only a THIRD of what they wanted? Having already paid £25 filing and, I presume, £25 for the hearing fee?

Yeah I mean they’re obviously not 100% confident they’ll win at court, otherwise they wouldn’t offer to accept £100 as opposed to £320+.

I have 7 days to accept/decline their offer, so will have to have a think.

A fairly well documented last throw of the dice by CEL in a last-ditch attempt to get something out of this, before they have to pay the hearing fee - or discontinue. Looks like this is on its way to a discontinuance , unless you blink first!
